PC RES 1981-034PLANNING COMMISSION RESOLUTION NO. 81-34 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DENYING VARIANCE NO. 63 WHEREAS, Variance No. 63 has been filed which requests that 54" high fencing in the easement and 10' high gates attached to 20' high posts in the front and street side setback be allowed to remain; and WHEREAS, the residence is located at 2810 Colt Road, which is in a RS -2 zoning district; and WHEREAS, the Planning Commission reviewed this matter at a public hearing on March 10, 1981, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1: That this variance is not necessary for the preservation and enjoyment of a substantial property right of the applicant which is possessed by others under like conditions in the same zoning district. It is not within the applicant's property right to construct a fence in the easement area. There is no necessity for gates that reach a height of 10' attached to 20' high posts. SECTION 2: That this variance would adversely affect the public safety and welfare. The fence is a physical barrier located in the right-of-way. SECTION 3: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby denies Variance No. 63, and requires that the fence be removed from the easement and that the gates and posts be cut to a maximum height of 42".
