PC RES 1981-033PLANNING COMMISSION RESOLUTION NO. 81-33 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 62 WHEREAS, Variance No. 62 has been filed which requests that a five (5) foot fence be allowed to remain in the front setback; and WHEREAS, the residence is located at 2 La Vista Verde, which is in a RS -2 zoning district; and WHEREAS, the Planning Commission reviewed this matter at a public hearing on February 24, 1981, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional or extraordinary circumstances or conditions applicable to the property or to the intended use of the property, which do not apply generally to other properties in the same zoning district, since conformance to the fencing limitations within the front setback will not allow for adequate screening. Section 2: That the variance is necessary for the preservation and enjoyment of a substantial property right of the applicant which is possessed by other property owners under like conditions in the same zoning district. The fence is necessary to provide protection from debris coming down from Palos Verdes Drive East and from vandalism. Section 3: That the granting of the variance will benefit the public welfare by allowing debris to be contained and more easily removed. Section 4: That the granting of such a variance will not be contrary to the objectives of the General Plan. Section 5: For the foregoing reasons, the Planning Commission of the City -6f Rancho Palos Verdes hereby approves Variance No. 62.
