PC RES 1981-031RESOLUTION P.C. NO. 81-31 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE 'NO. 61 WHEREAS, Variance No. 61 has been filed which requests that fence heights within the front yard setback exceed allowable heights; and WHEREAS, the residence is located at 3931 Palos Verdes Drive South which is in an RS -4 zoning district; and WHEREAS, the Planning Commission reviewed this matter at a public hearing held on January 27, 1981, at which time all interested parties were given an op- portunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional or extraordinary circumstances or conditions applicable to this property, or to the intended use of the property which do not apply generally to other properties in the same zoning district since conformance to the fencing limitations within the front setback will not allow for adequate screening because security and noise constraints place an extra burden on the need for screening. Also, there was some ambiguity in the Code regarding the necessary separation of walls and/or fences at the time this fence was con- structed. Section 2: That this variance is necessary for the preservation and en- joyment of a substantial property right of the applicant which is possessed by other property owners under like conditions in the same zoning district. Noise reduction and security make this finding required. Section 3: That the fence does not adversely affect the public welfare or the surrounding area. The fence does not obstruct anyone's view nor does it impact anyone's traffic safety. Section 4: That the fence is not contrary to the objectives of the General Plan. The fence will provide for safe, undisturbed use of a residence. Section 5: For the foregoing reasons the Planning Commission of the City of Rancho Palos Verdes hereby approves Variance No. 61.
