PC RES 1980-030RESOLUTION P.C. NO. 80-30 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DENYING VARIANCE NO. 59 WHEREAS, Elena Ramos Ledon has requested a variance for the construction of a single family residence with a maximum total height of thirty-eight and one-half (38-1/2) feet on property located at 30172 Cartier Drive, Tract No. 25160, Lot 139; and WHEREAS, after notice issued pursuant to the provisions of the Rancho Palos Verdes Development Code, a public hearing was held December 23, 1980, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That there are not exceptional or extraordinary circumstances applicable to the property involved, or to the intended use of the property, which do not apply generally to other property in the same zoning district, because there are alternative building and site designs available to alleviate the height problem. Section 2: That such variance is not necessary for the preservation and enjoyment of a substantial property right of the applicant, which right is possessed by other property owners under like conditions in the same zoning district, because it is possible to construct a single family residence on the subject property while remaining within the limits of the Rancho Palos Verdes Development Code. Section 3: That the concept of the proposed structure is contrary to the objectives of the Rancho Palos Verdes General Plan, since construction of the residence would violate grading and visual character policies. Section 4: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby denies Variance No. 59. APPROVED and ADOPTED this 23rd day of December 1 1980.
