NO. 80- 26 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES GRANTING CONDITIONAL USE PERMIT NO. 64 WHEREAS, Tentative Parcel Map No. 12431 and Conditional Use Permit No. 64 has been filed, which would allow for the division of a 42.3 acre parcel into two (2) parcels, each greater than the required one (1) acre; and WHEREAS",,,the project is located on the west side of Palos Verdes Drive West near the City's northern boundary in Subregion one of the City's Coastal Specific Plan area which is in an RS -1 -RPD zoning district. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That the proposed division of land is permitted in an RS -I -RPD zone, subject to a conditional use permit. Section 2: That the site is served by a private access drive off of Palos Verdes Drive -West and is adequate to carry the type and quantity of traffic generated by the proposed use. Section 3• That the site for the intended use is adequate in size and shape to accommodate the proposed division of land and meet all lot dimensions, setbacks, and open space requirements and other features as re- quired by this Code. Section 4: That the subject -use, with safeguards and conditions imposed by this permit, will cause no significant adverse effects to adjacent properties or the permitted uses thereof. Further, the Planning Commission does hereby declare that a negative declaration was granted in compliance with City and State guidelines and that the Commission has reviewed and considered the contents of the -initial study in reaching its decision. The Planning Commission further finds that the approval of this conditional use permit will not result in a significant adverse environmental impact. Section 5: That the subject use is in conformity with the General Plan and Coastal Specific Plan, which designate the site as appropriate for residential use. Section 6: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby grants approval of Conditional Use Permit No. 64 subject to the conditions found in Exhibit "A" which are necessary to protect and preserve the health, safety, and general welfare of the area. CONDITIONAL USE PERMIT NO. 64 IS APPROVED SUBJECT TO THE FOLLOWING CONDITIONS: 1. This approval expires two (2) years from this date unless a site plan for each lot is approved by the Director of Planning. 2. Final site, grading building and landscape plans shall be submitted to the Director of Planning prior to request for construction permits. Building heights for all structures cannot exceed "sixteen (16) feet above the highest point of the lot covered by the structure without approval of a height variation application. All other site improvements including but not limited to setbacks, retaining walls and site grading shall conform to the standards of the City Development Code. 3. A master landscape plan shAll be submitted in conjunction with the site plan or any revisions thereto. Said master landscape plan shall be re- viewed by the Director of Planning primarily for view obstruction poten- tial from the pbblid right-of-way. The landscape plan shall include but not be limited to all vegetation, irrigation, fences/walls, exterior light- ing, and recreation facilities. 4. Within thirty (30) days of the receipt of the signed resolution and conditions the applicant shall read and state in writing that he understands said conditions. Resolution P.C. NO. 80- 26
