PC RES 1980-023RESOLUTION P.C. NO. 80-23 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 52 WHEREAS, Variance No. 52 has been filed which would allow a room addi- tion to encroach to within ten feet five inches (10'5") of the rear property line at 28710 Atford Drive, which is in the RS -2 zone; and WHEREAS, the Planning Commission has reviewed this matter at public hearings held on September 23 and October 28, 1980, at which times all in- terested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional or extraordinary circumstances or conditions applicable to the property, or to the intended use of the prop- erty, which do not apply generally to other properties in the same zoning district, since the existing single family residence faces and is oriented towards Atford Drive, and because the structure is placed on the lot in such a manner that it is reasonable for the proposed second story addition to meet and match the existing first story wall. Section 2: That the variance is necessary for the preservation and enjoyment of a substantial property right of the applicant which is possessed by other property owners under like conditions in the same zoning district. Due to the location of the existing structure on the lot, the applicant is re- stricted from constructing an addition that will match the existing house. Section 3: That the granting of the variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located, since there is not evidence that a detrimental or injurious situation would occur. Section 4: That the granting of such a variance will not be contrary to the objectives of the General Plan. Because of the structure's position on the corner lot, if the front property line designation were changed to Atford Drive, the lot would provide for a twenty-four (24) foot front setback, a twenty-one (21) foot+ -street side setback (along Sparta Drive), a thirty (30) foot+ rear setback, and a ten foot five inch- (10'5") side yard setback. Section 5: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby approves Variance No. 52, subject to the conditions of Exhibit "A".
