PC RES 1980-018RESOLUTION P. C. NO. 80-18 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING CONDITIONAL USE PERMIT NO. 61 WHEREAS, Mr. and Mrs. Jack Atkinson have requested a conditional use permit to allow installation of eight (8) lights of a private tennis court located at 27990 Palos Verdes Drive East; and WHEREAS, following public notice, issued,pursuant to the provisions of the City's Development "Code, a public hearing was held on May 27, 1980, and additional public medtifiji°wer_e held on July 8, October 1, and October 14, 1980, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That the site is adequate in size and shape to accommodate said use and for all of the yards, setbacks, walls, fences, landscaping and other features required by the Development Code, and that a tennis court is a permitted use in an RS -2 zoning district. -1 Section 2: That Palos Verdes Drive East and a private driveway provide adequate vehicular access to the site, since thedwelling unit and private tennis court will not generate excessive traffic. Section 3: That the Planning Commission does hereby declare that the final Negative Declaration has been completed in compliance with State and local guid&-- lines and that the Commission has reviewed and considered the contents of the Ini- tial Study in reaching its decision. The PlanAing Commission further finds that a lighted private tennis court in this area will not result in a significant ad- verse effect on ddj aci&fit properties or permitted use thereof since conditions are hereby imposed to mitigate potential impacts. Section 4: That the use is not contrary to the General Plan, since pri- vate recreational uses are encouraged and the view impacts have been mitigated. Section 5: For the foregoing reasons, the Planning Cordhission of the City of Rancho Palos Verdes hereby grants approval of Conditional Use Permit No. 61 subject to the conditions found in Exhibit "A" of this resolution. The tennis court shall be used no earlier than 7:00 a.m. and no later than 9:00 p.m. (or dusk, whichever is later) on any day:. 2. That the lights be turned off when the court is not in use. 3. Light fixtures shall not exceed 1000 watts per bulb. 4. That the light housing and shields shall be painted with flat black paint in the manner presented to the Planning Commission on October 1, 1980. 5. That any change in the number, type, or intensity of light fixtures be approved by the Director of Planning. 6. That the applicant agree, in writing, within thirty (30) days to this resolution and conditions. 7. That installation of hanger arms shall not exceed six (6) feet. Resolution P.C. No. 80-18
