PC RES 1980-016 411 411 RESOLUTION P.C. NO. 80 - 16 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES GRANTING VARIANCE NO. 50 WHEREAS, Variance No. 50 has been filed, which would allow a fence/wall combination within the front yard setback to exceed the allowable height at 28018 San Nicolas Drive, which is in an RS-4 zoning district; and WHEREAS, the Planning Commission has reviewed this matter at a public hearing held on August 12, 1980 , at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property, or to the intended use of the property, which do not apply generally to other properties in the same zoning district because the property owner is denied the primary use of the garage due to the high slope of the driveway. Section 2. That the variance is necessary for the preser- vation and enjoyment of a substantial property right of the applicant which is possessed by other property owners under like conditions in the same zoning district. The wall/rail combination will allow the property owner to alter the driveway access to permit adequate entrance into the garage. Section 3. That the granting of the variance will benefit the public welfare by allowing for off-street parking and improvement to the traffic circulation on San Nicolas Drive. Section 4 . That the granting of such a variance will not be contrary to the objectives of the General Plan. The wall/rail combination will insure reasonable access to the garage by allowing grading to alter the driveway slope. Section 5. For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby approves Variance No. 50. APPROVED AND ADOPTED this 12th day of August, 1980.
