PC RES 1980-001RESOLUTION P.C. NO. 80-_1 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DENYING VARIANCE NO. 42 WHEREAS, Tentative Parcel Map No. 12404 has been filed, which would allow for the division of a 1.01 acre lot into two (2) parcels subject to approval of a variance to permit a 64.09 foot minimum lot width in lieu of the Code required 90 feet on the property located at 27865 Palos Verdes Drive East; and WHEREAS, after notice issued pursuant to the provisions of the Rancho Palos Verdes Development Code, a public hearing was held January 22, 1980 at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THERFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That there are not exceptional or extraordinary circumstances applicable to the property involved, or to the intended use of the property, which do not apply generally to other property in the same zoning district, be- cause the placement of the existing dwelling is not an exceptional or extra- ordinary circumstance rather a self-imposed circumstance, and minimum lot width requirements are applicable to other properties in the same zoning district. Section 2: That such variance is not necessary for the preservation and enjoyment of a substantial property right of the applicant, which right is pos- sessed by other property owners under like conditions in the same zoning dis- trict, because other property owners in the RS -2 zoning district do not possess the right to create a new lot less than what the required standards dictate. Section 3: That the granting of a variance will not be materially detri- mental to the public welfare or injurious to property and improvements in the area in which the property is located, since there is no substantial evidence that such an effect would occur. Section 4: That the variance is not in conflict with the General Plan and the accompanying land use map since the resulting gross density is permitted by the General Plan. Section 5: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby denies Variance No. 42. APPROVED and ADOPTED this 12th day of February, 1980.
