PC RES 1979-022 110 1111 RESOLUTION P.C. NO. 79-22 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES RECOMMENDING TO THE CITY COUNCIL OF SAID CITY AMENDMENTS TO THE MUNICIPAL CODE FOR THE REGULATIONS OF STRUCTURES IN THE OPEN SPACE HAZARD DISTRICT THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES HEREBY RESOLVES, DETERMINES AND RECOMMENDS AS FOLLOWS: Section 1: That the City Council initiated a Code Amendment on Octo- ber 2, 1979. Section 2: That a Negative Declaration was issued for the project and the Planning Commission has considered the contents of the Initial Study. Section 3: That the Planning Commission held a duly noticed public hearing on November 27, 1979 at which time all interested persons presented testimony. Section 4: That the Planning Ca mnission hereby recommends to the City Council that the Rancho Palos Verdes Municipal Code be amended as follows: 1. Article IX, Chapter 4, Part 1, Section 9412, Subsection F of the Rancho Palos Verdes Municipal Code is amended to read: Within areas currently experiencing downslope movement, only residential single family buildings and structures existing on June 26, 1975 may be used, or restored providing: 1. The owner files a non-suit covenant with the City of Rancho Palos Verdes relieving said City of responsibility related to whatever hazard may exist. 2. Said restoration will not aggravate the present condition. 3. Homes must be occupied or the owners must make application for restoration or replacement within one year of damage. 4. Restoration or replacement shall be limited to the same square footage and in the same general location on the property. 5. Setbacks may be waived for restoration upon application to the Director of Planning. 6. If more than ninety (90) percent of the structure is des- troyed by earth movement the structure may not be replaced or repaired. Section 5: The Secretary shall certify to the adoption of this reso- lution and shall forward copies of the same to the City Council. PASSED, APPROVED, and ADOPTED this 27th day of November, 1979.
