A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES DENYING CONDITIONAL USE PERMIT
NO. 48 AND VARIANCE NO. 36
WHEREAS, Lester Barron has requested a conditional use permit for a
community care facility to be located on Crestridge Road and variances to the
City's standards regarding height and parking; and
WHEREAS, after notice issued pursuant to the provisions of the City's
Development Code, public hearings were held February 27 and March 13, 1979, at
which time all interested parties were given an opportunity to be heard and pre-
sent evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: That the site for the intended use is not adequate in size
and shape to accommodate said use and for all of the yards, setbacks, walls or
fences, landscaping and other features required by this Code.
Section 2: That the site for the proposed use relates to streets and
highways properly designed to carry the type and quantity of traffic generated
by the subject use.
Section 3: That, in approving the subject use at the specific location,
there would be a significant adverse effect on adjacent property or the permitted
use thereof.
Section 4: That the proposed use is not in compliance with the General
Plan.
Section 5: That there are not adequate safeguards proposed to insure
protection of the public health, safety, and general welfare of the area.
Section 6: Specifically, the project would:
a. Adversely impact an important natural ridgeline;
b. Not minimize the disturbance to natural contours; and
C. Be too intense for the subject site.
Section 7: For the foregoing reasons, the Planning Commission of the
City of Rancho Palos Verdes hereby denies approval of Conditional Use Permit No. 48.
Section 8: That since the conditional use permit is denied and the
variance applications are dependent on the conditional use permit, the Planning
Commission cannot make the findings necessary to approve the variance applications
and hereby denies Variance No. 36.
