NO. 78-49 • A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING CONDITIONAL USE PERMIT NO. 36 WHEREAS, Frank Iacono has requested a conditional use permit to allow installa- tion of eight (8) lights on a private tennis court located at 30421 Miraleste Drive; and WHEREAS, following public notice, issued pursuant to the provisions of the City's Development Code, public hearings were held on May 9 and October 12, 1978, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, the Planning Commission of the City of Rancho Palos Verdes does hereby find, determine and resolve as follows: Section 1: That the site is adequate in size and shape to accommodate said use and for all of the yards, setbacks, walls, fences, landscaping and other features re- quired by the Development Code, since a variance (#26) has been granted for a reduction in the front yard setback for a tennis court fence, and since conditions are imposed. Further, a private tennis court is a permitted use in an RS -2 zoning district. Section 2: That Miraleste Drive and a private driveway provide adequate vehicular access to the site, since the dwelling unit and private tennis court will not generate excessive traffic. Section 3: That a lighted private tennis court in this area will not result in a significant adverse affect on adjacent properties or permitted use thereof since condi- tions are hereby imposed to mitigate potential impacts. Section 4: That the use is not contrary to the General Plan, since private recrea- tional uses are encouraged and the view impacts have been mitigated. Section 5: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hdreby grants approval of Conditional Use Permit No. 36 subject to ,.the conditions found in Exhibit "A" of this resolution. Hightower 44 Director of Planning EXHIBIT "A" CONDITIONAL USE PERMIT NO. 36 IS APPROVED SUBJECT TO THE FOLLOWING CONDITIONS: 1. The tennis court shall be used no earlier than 7 a.m. nor any later than 9 p.m. (or dusk, whichever is later) on any day). 2. The lights shall be turned off when --the court is not in use. 3. Light fixtures shall not exceed 400 watts per bulb. 4. Windscreens kept in good repair shall be required for all nighttime play. 5. Any change in the number or intensity of light fixtures or type windscreens shall be reported by the property owner to the Director of Planning for review. Resolution P.C. No. 78-49
