PC RES 1978-037RESOLUTION P.C. NO. 78-37 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES GRANTING VARIANCE NO. 31 WHEREAS, Desmond and Ann Armstrong have requested a variance for a two (2) foot encroachment into the City's thirty (30) foot height limitation for an addition which will connect a detached garage with the main structure on the property located at 30132 Via Borica; and WHEREAS, after notice, issued pursuant to the provisions of the City's Development Code, a public hearing was held on July 11, 1978, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, the Planning Commission of the City of Rancho Palos Verdes does hereby find, determine, and resolve as follows: Section 1: That there are exceptional or extraordinary circumstances or conditions applicable to the property, or to the intended use of the property, which do not apply generally to other property in the same zoning district for the following reasons: A. The house and detached garage are separated in vertical configuration so as to cause a technical violation of the ordinance when connected. B. The great majority of houses in the City do not have such a configuration. C. Other residents in the immediate vicinity with similar house/garage configurations could make the identical addition without need for the variance because some have a smaller vertical house/garage separation. Section 2: That the variance is necessary for the preservation and enjoyment of a substantial property right of the applicant, which is possessed by other property owners under like conditions in the same zoning district. Others with usual house/garage configurations would be permitted an addition of similar height and size. Section 3: That the granting of the variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area, as the height of the structure is not actually being increased. Section 4: That the intended use is not contrary to the General Plan. Section 5: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby grants approval of Variance No. 31. APPROVED and ADOPTED this 11th day of July, 1978.
