PC RES 1977-015RESOLUTION NO. 77-15 (P.C.) A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES GRANTING VARIANCE NO. 17 FOR THE ENCROACHMENT OF A STRUCTURE INTO A REQUIRED SIDE SETBACK WHEREAS, Mr. Stanford Riddle has requested a variance, which would allow a barbeque-lanai structure to encroach approximately three feet nine inches (3'9"+) into the required five (5) foot side yard setback at 6829 Vallon Drive; and WHEREAS, after notice issued pursuant to the provisions of the City's Development Code, a public hearing was held on July 12, 1977, at which time all interested parties were given an opportunity to be heard and to present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: There are exceptional or extraordinary circumstances or conditions applicable to the subject property, or to the intended use of the property, which do not apply generally to other property in the same zoning district, since a storm drain easement, held by Los Angeles County, restricts full and complete usage of the property, thereby necessitating an encroachment into the required five (5) --foot side yard setback. Section 2: The variance is necessary for the preservation and en- 3oyment of a substantial property right of the applicant which is pos- sessed by other property owners under like conditions in the same zoning district since by placing the structure in the side setback area opposite the storm drain easement, the applicant will retain maximum benefit of the golf course view which is enjoyed by neighbors in a similar situation. Section 3: The granting of the variance will not be materially detrimental to the public welfare or injurious to property improvements in the area in which the property is located since the adjoining property owners have consented to said structure and since it will obstruct no views. Section 4: The granting of this variance will not be contrary to the objectives of the General Plan. Section 5: For the foregoing reasons, -the Planning Commission of the City of Rancho Palos Verdes hereby grants approval of Variance No. 17. APPROVED and ADOPTED this 26th day of July 11 1977.
