PC RES 1976-013RESOLUTION P.C. 76-13 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES GRANTING A CONDI- TIONAL USE PERMIT FOR A PLANNED DEVELOPMENT IN AN RM -8 MULTIPLE FAMILY RESIDENTIAL DISTRICT WHEREAS, Cayman Development Company has requested a conditional use permit to allow a planned development on a 14.93 acre site located on Highridge Road, south of Hawthorne Boulevard, with the subject site fal- ling within an RM -8 multiple family district; and WHEREAS, after notice issued pursuant to the provisions of the City's Development Code, public hearings'were held on November 23, and December 13, at which time all interested parties were given an opportunity to be heard and to present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That the proposed planned development is permitted in the RM -8 District, subject to the issuance of a conditional use permit. Section 2: That the 14.93 acre site located on Highridge Road, south of its intersection with Hawthorne Boulevard is adequate in both size and configuration to allow 90 single family attached units in a planned devel- opment and for all of the open space requirements, private outdoor living area, landscaping and other features required by the City's Development Code or by conditions imposed in this conditional use permit. Section 3: That the proposed planned development is not contrary to the General Plan and said conformance is insured by conditions imposed with this report. Section 4: That the planned development will locate its point 6f ingress/egress on Highridge Road which is properly designed to carry both the type and quantity of traffic generated. Section 5: That given the project's location, site design, and con- ditions imposed through this permit, the granting of this conditional use permit will not adversely affect the peace, health, safety, or general welfare of the area, nor will it be materially detrimental to property values, jeopardize, endanger or otherwise constitute a menace to the pub- lic health, safety and welfare of persons or properties in the surrounding area. Section 6: That the Planning Commission does hereby certify that the Final Environmental Impact Report has been completed in compliance with CEQA and state guidelines and that the Planning Commission has reviewed and considered the contents of the report in reaching its decision. The Planning Commission further finds that the approval of this conditional use permit will not have a significant adverse environmental impact. Section 7: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby grants a conditional use permit for the use described herein, subject to the conditions contained in Exhibit "A", which are necessary to protect the public health, safety, and general welfare in the area. Hightower Director of Planning a d Secretary to the Commission Ann Shaw Chairperson EXHIBIT "A" Conditional Use Permit No. 19 is approved subject to the following con- ditions: 1) Prior to issuance of a building or grading permit, and prior to ap- proval of a final map, a bond, or other acceptable security, -shall be posted to ensure the completion of all common area and off-site improvements including: landscaping, recreational facilities, and other site features as per approved plans. 2) No occupancy permit shall be granted for any structure and no par- cels, lots or portion of the site shall be separately sold or encum- bered, until approval of the Director of Planning, upon the finding that all of the common area and off-site improvements are completed to the extent that the dwelling units are accessible and livable, and all dwelling units are substantially developed (all building walls covered), as per the approved plans. A bond or other guarantee of substantial completion of all dwelling units may be accepted by the City in lieu of substantial completion. 3) If construction has not been completed to the point of foundation in- spection for a unit within one (1) year, or has not been completed within two (2) years from the date of final approval, the conditional use permit shall expire and be of no further effect, and any final map for the subdivision of land within such development shall become null and void, and the owner of the property shall cause the sub- division to revert to acreage. 4) A landscaping plan shall be submitted for approval by the Director of Planning. Said plan shall include, but not be limited to, plant materials (both proposed and existing), walls/fences, and exterior lighting. This plan will be evaluated for its effects on adjacent properties and visual appearance from Highridge Road_and adjacent _ streets.' This landscaping plan should not only be aesthetic in character, but also functional in terms of visually screening elements, such as the tennis courts, from viewing along said streets. 5) If tennis court lighting is proposed, a plan shall be submitted for review and approval by the Planning Commission. 6) No building shall exceed 30 feet in height, as measured from the average elevation of finished grade to the highest point of the struc- ture. 7) No more than 90 single family attached dwelling units shall be per- mitted. 8) Final building and site plans, including elevations, private outdoor living area, and lighting shall be submitted to the Director of Planning for approval. 9) All attached residential units shall conform to the development stan- dards established in Chapter 1, Part 4 of the Development Code. 10) All necessary legal agreements and documents, including homeowners' association, deed restrictions, covenants, dedication of development rights, easement, and proposed method of maintenance and perpetuation of open space areas, shall be submitted and approved by the City Attorney and the Director of Planning prior to approval of the final map 11) Emergency access (20 -foot minimum) shall be provided at or near the existing driveway easement on the southeast side of the property. 12) Approval of this conditional use permit is subject to the approval of Tentative Tract Map No. 32677 by the City Council without substantial changes or modifications hereto.
