PC RES 1976-011RESOLUTION NO. 76-11 P.C. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES GRANTING A CONDITIONAL USE PERMIT FOR THE ERECTION OF THREE TRANSMITTING ANTENNA POLES IN A SINGLE FAMILY RESIDENTIAL ZONE WHEREAS, Don C. Wallace has requested a Conditional Use Permit to erect three transmitting antenna poles at 28503 Highridge Road in a single family residential zone; and WHEREAS, after notice issued pursuant to the provisions of the City's zoning ordinance, a public hearing was held on August 10, 1976, at which time all interested parties were given an opportunity to be heard and to present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALSO VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That the proposed use is permitted in the zone, subject to the issuance of a conditional use permit. Section 2: The site proposed for the construction of three additional antenna is zoned RS -4 (10,000) and consists of approximately 24 vacant acres. The property is adequate in size and shape to accom- modate the proposed use and for all the yard setbacks, walls or fences, landscaping or other features required by this code or by conditions proposed under this section to adjust said use with those on abutting land and within the neighborhood. Sedtion 3: That the construction of three additional antennae on the property are not expected to generate any additional traffic flow. Section 4: That given the existence of 60 poles on the property as an existing non -conforming use, the size of the 24 -acre parcel and its location which is substantially removed from adjoining residences, the granting of the conditional use permit will not ad- versely affect the peace, health, safety or general welfare of the area, nor will it be materially detrimental to property values, jeopardize, endanger or otherwise constitute a menace to the public health, safety and welfare of persons or properties in the surrounding area. Section 5: That the proposed use is not contrary to the General Plan. Section 6: That the Planning Commission in requiring those safeguards listed in Exhibit "A" which is attached hereto and made a part hereof deem said requirements to be the minimum necessary to protect the health, safety and welfare of the community. Section 7: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby grants a Conditional Use Permit for the use described herein, subject to those conditions con- tained in Exhibit "A". Hightower Secretary to the Commission EXHIBIT "A" Conditional Use Permit 18 is approved subject to the following conditions: . One (1) antenna pole may be used for commercial purposes, subject to the following limitations: A. The subject antenna pole shall not exceed ninety-five (95) feet in height. B. The subject antenna pole shall be limited to four (4) cross arm pairs. C. Each cross arm pair shall consist of no more than two (2) members, each having a maximum length of ten (10) feet and lying in a plane. 7 D. Each cross arm pair shall be restricted to four (4) antennae of similar configuration to those which currently exist. 2. Two additional antenna poles may be erected; however, said poles shall be used for non-commercial purposes only and shall be limited to a height which does not exceed any existing antenna pole currently located on the subject property.
