PC RES 2013-013 P.C. RESOLUTION NO, 2013-13 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES FINDING THAT THE CITY'S UPDATED 2013 CAPITAL IMPROVEMENTS PLAN (CIP) IS CONSISTENT WITH THE GOALS AND POLICIES OF THE RANCHO 'PALOS VERDES GENERAL PLAN. WHEREAS, Sections 65103 & 65401 of the California Government Code require that the Planning Commission review the City's Capital Improvements Program for its conformance with the City's General Plan; and, WHEREAS, on June 18, 2009, the City Council adopted the 2009 Five-Year Capital Improvement Plan, which represents the City's 5-year program for prospective capital improvements for creating, maintaining, and funding present and future infrastructure requirements. The CIP addresses the City's needs relating to the acquisition, expansion, and rehabilitation of long-lived facilities and infrastructure; and, WHEREAS, since adoption of the 2009 Five-Year Capital Improvement Plan, additional needs were identified and additional projects were included in the 2010 update to the Five-Year Capital Improvement Plan, which was determined to be consistent with the goals and policies of the City's General Plan by the Planning Commission on May 11, 2010 and subsequently approved by the City Council on May 22, 2010; and, WHEREAS, since adoption of the 2010 Five-Year Capital Improvement Plan, additional needs were identified and additional projects were included in the 2011 update to the Five-Year Capital Improvement Plan, which was determined to be consistent with the goals and policies of the City's General Plan by the Planning Commission on May 24, 2011 and subsequently approved by the City Council on June 7, 2011; and, WHEREAS, since adoption of the 2011 Five-Year Capital Improvement Plan, additional needs were identified and additional projects were included in the 2012 update to the Five-Year Capital Improvement Plan, which was determined to be consistent with the goals and policies of the City's General Plan by the Planning Commission on June 12, 2012 and subsequently approved by the City Council on June 19, 2012; and, WHEREAS, since the 2012 update of the CIP, additional needs have been identified and additional projects have been included in the 2013 update to the Five-Year Capital Improvement Plan; and, WHEREAS, the Planning Commission conducted a hearing on May 28, 2013 for consideration of a General Plan Consistency finding to determine its conformity with the City's General Plan, and at which time all interested parties were given an opportunity to be heard and present evidence, and a decision was rendered on that same date. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: The City's CIP continues to be consistent with the applicable goals and policies of the Rancho Palos Verdes General Plan, and believes that the additional projects identified also further the goals and policies of the City's General Plan with regards to the goals P.C. Resolution No. 2013-13 Page 1 and objectives of the General Plan Natural Environment, Socio/Cultural, Urban Environment, Infrastructure, Safety, Land Use, and Fiscal Elements. Section 2: The 2013 Capital Improvements Plan (CIP) conforms to the City's General Plan. Section 3: Any interested person aggrieved by this decision or by any portion of this decision may appeal to the City Council. Pursuant to Section 17.80.070 of the Rancho Palos Verdes Municipal Code, any such appeal must be filed with the City, in writing, setting forth the grounds of the appeal and any specific actions requested by the appellant, and accompanied by the appropriate appeal fee, no later than fifteen (15) days following May 28, 2013, the date of the Planning Commission's final action. Section 4: For the foregoing reasons and based on the information and findings included in the Staff Report, Minutes and all other records of the proceedings, which are attached hereto and made a part thereof by reference, the Planning Commission hereby finds that the City's updated 2013 Five-Year Capital Improvement Plan (CIP) is consistent with the goals and policies of the Rancho Palos Verdes General Plan.
