RESOLUTION NO. 2013-09 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING, WITH CONDITIONS, A SITE PLAN REVIEW PERMIT TO ALLOW THE CONSTRUCTION OF A 192 SQUARE FOOT ADDITION TO THE 1sT-FLOOR WITH A NEW ROOF DECK ACCESSIBLE FROM THE 2N°-FLOOR HABITABLE SPACE, AND ARCHITECTURAL FEATURE MODIFICATIONS ATHAT MEASURE 23'-4" TALL, AT THE REAR OF AN EXISTING 2-STORY RESIDENCE LOCATED AT 30517 CAMINO PORVENIR (ZON2012- 00410).. WHEREAS, on December 7, 2012, the applicant and homeowner submitted a Height Variation and Site Plan Review application, with. Neighborhood Compatibility, to the Community Development Department, which was deemed incomplete on December 18, 2012; and, WHEREAS, after additional information was submitted on January 17, 2013, in which the revised plans no longer required a Height Variation permit, the application was deemed incomplete on January 30, 20113; and, WHEREAS, after additional information was submitted on February 13, 2013, March 5, 2013 and March 7, 2013, the application was deemed generally complete for processing on March 14, 2013; and, WHEREAS, on March 19, 2013, notice of public hearing was sent to all properly owners within 500 feet of the subject site; and, WHEREAS, on March 21, 2013, the notice of public hearing was published in the Palos Verdes Peninsula News; and, WHEREAS, pursuant to the provisions of the California Environmental Quality Act, Public Resources Code Sections 21000 et. seq. ("CEQA"), the State's CEQA Guidelines, California Code of Regulations, Title 14, Section 15000 et. seq.„ the City's Local CEQA Guidelines, and Government Code Section 65962.5(f) (Hazardous Waste and Substances Statement), Staff found no evidence that the Site Plan Review application will have a significant effect on the environment and, therefore, the proposed project has been found to be categorically exempt under Class 1 (Section 15301); and, WHEREAS, on April 9, 2013, the Planning Commission held a public hearing, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: The Site Plan Review request is for the construction of a 192 square foot addition to the north-west corner of the residence, consisting of 192 square feet of habitable space with a 192 square foot roof deck directly above, architectural modifications to the 2-story portion of the fagade and roof, and one new chimney at the rear of the existing residence. Section 2: The scale of the roof deck is compatible with the immediate area, as the total square footage of the roof deck on the property is within the scale of other residence sizes; is hidden behind the main residence in the back yard; is not easily seen from the road; and the overall lot coverage does not exceed that which is allowedby the zoning nor what is seen in aerial photos of the neighborhood. Resolution No. 2013-09 Page 1 of 4 Section 3: The architectural style of the roof deck is cO0DGtN8 with the immediate area, as the pnnonned project was designed to match the rnah*hm|s of the main residemoe, as well as reflect other architectural features seen among the residences in the immediate neighborhood; the structure height does not significantly impair the view from the viewing areas of surrounding properties; nor does the structure spacing between structures alter what currently existing between the existing residence and neighboring structures or what is currently ,seen within the immediate neighborhood. Section 4: The setbacks for the roof deck is cornpaUU|n with the immediate area, as there were other similar structures observed in the immediate neighborhood that currently match the required side yard setback standards in asimilar manner oothe proposed addition. Additiona||y, the proposed location still affords comparable space between adjoining property structures. Section 6: The proposed 23`-4" tall architectural feature modifications to the rear fagode and roof may exceed the 16'-0" maximum height for residential structures as there are no significant impacts to v|avv3 from other properties, will not exceed the rnaxirnunn height of the existing structure (measuring 27'-6" tall) and will beconditioned to obtain all necessary building permits so that it will be consistent with the requirements of the building code. Section 6: Any interested person aggrieved by this decision or any portion of this decision may appeal tOthe City Council. The appeal shall set forth the grounds for appeal and any specific action being requested by the appellant, Any appeal letter rnuaf be filed within fifteen (15) calendar days of the date of this decision, or by 5:30 PM on VVedneadey. April 24, 2013. ZON2012-00410 (SPR) 30517 CAMINO PORVENIR 1 Approval of this Site Plan Review Permit shall not be construed to mean any waiver of applicable and appropriate zoning regulations, or any Federal, State, County, and City laws and regulations, Unless otherwise expressly specified, all other requirements of the City of Rancho Palos Verdes Municipal Code shall apply, 2. The approval shall become null and void after 1 year from the date of approval unless the approved plans are submitted to the Building and Safety Division to initiate the "plan check" review process, pursuant to Section 17.86.070 of the City's Development Code. This approval shall become null and void if, after initiating the "plan check" review process, said, "plan check" or permit is allowed to expire or is withdrawn by the applicant, 1 The applicant/property owner shall submit to the City a statement, in writing that they have read, understand and agree to all conditions of approval listed below. Said statement shall be submitted to the Community Development Director prior to submittal of plans to "plan check" or within ninety (90) days of the effective date of approval, which ever occurs first. Failure to provide said written statement shall render this approval null and void. 4. This approval of a Site Plan Review Permit is for additions of 192 square feet with a 180 square foot roof deck, architectural modifications to the fagade and roof, and one new chimney at the rear of an existing single-family residential property. 5. The approved project shall maintain the setbacks depicted on the stamped approved plans, but in no case shall minimum setbacks be less than the following Front Yard: 20'-0" (no change) Rear Yards 15-0" (proposed: 52'-10") Side Yard; 5'-0" (7'-3" proposed along the western side interior property line; 10'-1" proposed along the eastern side interior property line) 6. The height of the proposed addition, roof deck, architectural modifications and chimney shall be as depicted on the stamped approved plans, with the proposed addition and roof deck measuring 14'-2" tall, the proposed architectural feature modifications measuring 23'-4" tall, and the proposed new chimney not to exceed the minimum height required for compliance with the Uniform Building Code. SUBJECT TO REVIEW AND APPROVAL BY THE BUILDING OFFICIAL, A RIDGE HEIGHT CERTIFICATION IS REQUIRED BY A LICENSED LAND SURVEYOR OR CIVIL ENGINEER PRIOR TO INSTALLATION OF ROOF MATERIALS. 7. Unless modified by the approval of future planning applications, the approved project shall maintain a maximum of forty-five (45%) percent lot coverage (42% proposed). 8. Any outdoor furnishings, accessories or plants located on a 'roof deck" shall not exceed a height of eight feet or the bottom of the roof eave, whichever is lower, as measured from the finished floor of the deck, 10. Any outdoor furnishings, accessories or plants located on a "roof deck" which exceed the height limits established in Section 17.02.040, shall not significantly impair a view from surrounding properties. 11. The Community Development Director is authorized to approve minor modifications to the conditions of approval and/or the approved plans, provided such modifications will achieve substantially the same results as would strict compliance with the original plans or conditions. Any modifications the Director does not deem minor requires approval from the original final decision body. 12. Permitted hours of construction are 7:00 a.m. to 7:00 p.m. Monday through Saturday. No work is permitted on Sundays or legal holidays. Trucks and other construction vehicles shall not park, queue and/or idle at the project site or in the adjoining public rights-of-way before 7:00 AM, Monday through Saturday, in accordance with the permitted hours of construction stated above. 13. The project development on the site shall conform to the specific standards contained in these conditions of approval or, if not addressed herein, shall conform to the single- family residential development standards of the City's Municipal Code. 14. The construction site, adjacent public and private properties shall be kept free of all loose materials resembling trash and debris in excess of that material used for immediate construction purposes. Such excess material may include, but not be limited to: the accumulation of debris, garbage, lumber, scrap metal, concrete asphalt, piles of earth, salvage materials, abandoned or discarded furniture, appliances or other household fixtures. 15. In the event that a Planning requirement and a Building & Safety requirement are in conflict with one another, the stricter standard shall apply. 16. Failure to comply with and adhere to all of these conditions of approval may be cause to revoke the approval of the project pursuant to the revocation procedures contained in Section 17.86.060 of the City's Municipal Code. 17. Exterior residential lighting shall be in compliance with the standards of Section 17.56,030 of the Rancho Palos Verdes Development Code. No outdoor lighting is permitted where the light source is directed toward or results in direct illumination of a parcel of property or properties other than that upon which such light source is physically located. 18. All landscaping and construction activities shall exercise effective dust control techniques, either through screening and/or watering. 19. The construction site shall be maintained in a secure, safe, neat and orderly manner. Temporary portable bathrooms shall be provided on the construction site if required by the City's Building Official. Said portable bathrooms shall be subject to the approval of the City's Building Official and shall be placed in a location that will minimize disturbance to the surrounding property owners, P.C.
