PC RES 2011-018 P.C. RESOLUTION NO. 2011-18
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES STATING THAT AFTER REVIEWING THE
RESULTS OF THE TRIMMING OF THE CITY TREES NO. 1-10 PER
P.C. RESOLUTION 2011-01, THE SIGNIFICANT VIEW IMPAIRMENT
HAS BEEN ELIMINATED FROM THE FOUR APPLICANTS' VIEWING
AREAS LOCATED AT 7306, 7315, 7333, and 7284 BERRY HILL
DRIVE.
WHEREAS, a resolution was presented to the Planning Commission at the meeting of
January 11, 2011 for the approval of CTRP2008-00031, as amended, and this Resolution
(Planning Commission Resolution No. 2011-01) was approved and signed by the Chairman of
the Planning Commission; and,
WHEREAS, P.C. Resolution 2011-01 was not appealed within the 15-day appeal period
and so was made final at 5:30pm on January 26, 2011; and,
WHEREAS, pursuant to Section 17.80.120 of the Municipal Code, and P.0 Resolution
2011-01, the appellants and other contributors to the appeal fee had the full cost of the appeal
($2,255.00) refunded to them within 30 days of the January 11, 2010 meeting; and,
WHEREAS, per Condition No. 6 of P.C. Resolution 2011-01, signed and notarized
adoption covenants for Tree Nos. 1-10 were submitted to Staff by 12:00pm on February 15,
2011; and,
WHEREAS, per Condition No. 9 of P.C. Resolution 2011-01, on February 14, 2011 and
February 23, 2011, the City had a biologist inspect Tree Nos. 1-10 to determine whether there
was an active nest(s) in any of the trees. The biologist identified one nest in Tree No. 8, but this
nest was not active; and,
WHEREAS, as no active nests were found in Tree Nos. 1-10, per the requirements of
Condition No. 9 of P.C. Resolution 2011-01, the City's contracted tree trimming company, West
Coast Arborists, Inc., completed the trimming of Tree Nos. 1-10 on February 17, 18 and 24,
2011; and,
WHEREAS, in February 2011, Staff observed the views and took photographs of the
trimmed trees from the applicants' viewing areas; and,
WHEREAS, per Condition No. 8 of P.C. Resolution No. 2011-01, Staff scheduled a duly
noticed public hearing before the Planning Commission for the sole purpose of determining if
the tree trimming as described above has eliminated the significant view impairment for the four
applicants; and,
WHEREAS, notice of the public hearing was issued on March 24, 2011 pursuant to the
requirements of the Rancho Palos Verdes Development Code, a draft Resolution was
presented to the Planning Commission for approval and signature at the Planning Commission
meeting of April 12, 2011.

NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: As defined by Section 17.02.040 of the City's Development Code, the
Applicants at 7306 Berry Hill Drive, 7315 Berry Hill Drive, 7284 Berry Hill Drive and 7333 Berry
Hill Drive have a view of the Ocean and Catalina Island.
Section 2: The Applicant's viewing area at 7306 Berry Hill Drive, as defined by Section
17.02.040 of the City's Development Code, is from the living room/dining room. The Applicant's
viewing area at 7315 Berry Hill Drive, as defined by Section 17.02.040 of the City's
Development Code, is from the living room. The Applicant's viewing area at 7284 Berry Hill
Drive, as defined by Section 17.02.040 of the City's Development Code, is from the dining area
next to the kitchen. The Applicant's viewing area at 7333 Berry Hill Drive, as defined by Section
17.02.040 of the City's Development Code, is from the living room.
Section 3: The completion of the initial trimming by the City of the ten (10) City-owned,
and privately-adopted Canary Island Pine Trees located on Via Cambron and Via Collado has
eliminated the significant view impairment from the four applicant's properties located at 7306,
7315, 7284 and 7333 Berry Hill Drive.
Section 4: Pursuant to Section 15304 of the California Environmental Quality Act, the
proposed project is categorically exempt under Class 4 of that section because the work
required to restore the Applicants' view does not include the removal of scenic and mature
Trees as identified by the City of Rancho Palos Verdes General Plan (Visual Aspects; Figure
41). This finding, demonstrates that the decision complies with the provisions of CEQA because
the decision does not cause any significant adverse environmental impacts. Since the subject
Trees are not considered to be scenic or mature Trees as identified in the City's General Plan,
the environmental impacts due to trimming and/or removal are insignificant.
Section 5: Any interested person aggrieved by this decision or by any portion of this
decision may appeal to the City Council. Pursuant to Section 17.202.040 (2)(g) of the Rancho
Palos Verdes Municipal Code, any such appeal must be filed with the City, in writing and with
the appropriate appeal fee, no later than fifteen (15) days following the date of the Planning
Commission's final action.
Section 6: For the foregoing reasons and based on the information and findings
included in the staff report, the Planning Commission of the City of Rancho Palos Verdes
hereby finds that the trimming of the City Trees No. 1-10 per P.C. Resolution 2011-01 has
eliminated the significant view impairment for the four applicants' properties, and that no
.additional trimming is required. This P.C. Resolution 2011- and the attached Conditions of
Approval including Exhibits "A" through "D" shall supersede P.C. Resolution 2011-01.

CONDITIONS OF APPROVAL
FOLLOW-UP TRIMMING REVIEW FOR CTRP2008-00031
1. Tree Nos. 1-3 shall be heavily laced on an annual basis by the adopting party.
2. Tree Nos. 5-9 shall be trimmed down annually to the horizon line as viewed from the
viewing area at 7333 Berry Hill Drive and heavily laced by their respective adopting
parties.
3. Tree No. 10 shall be trimmed down annually to the horizon line as viewed from the
viewing area at 7315 Berry Hill Drive and heavily laced.
4. Tree No. 4 shall be removed in early May 2011 and replaced with a 24-inch box size tree
(see Condition #4 of P.C. Resolution 2011-01) as the tree-abutting resident has
submitted recent written notice that they do not wish to consent to the adoption of Tree
No. 4.
5. As Tree No. 4 will be removed and replaced, and as the adoption covenant for Tree No.
4 currently also includes Tree No. 7, a new adoption covenant for Tree No. 7 shall be
signed by the residents at 30466 Via Cambron within 15-days of the date of approval of
this Resolution.
6. All maintenance trimming of any adopted trees is to be completed annually between
November 1 st and February 1 st.
7. If at any time any of the adopted trees die or become diseased as defined by the City
Arborist or present a safety hazard or damage public improvements or utilities as defined
by the Director of Public Works consistent with City Council Resolution 97-18, the tree
shall be removed and replaced by the City on a 1:1 basis with a 24-inch box size tree,
the variety of which shall be one of the following Trees which has been approved by the
Public Works Department: 1) Ornamental Pear tree, 2) New Zealand Christmas tree, 3)
Brisbane Box tree, or 4) Chinese Elm tree.
8. If a resident tree adopter contracts with the City's contracted tree trimming company,
WestCoast Arborists, Inc. (WCA) to trim the adopted tree(s), the contract is exclusively
between the resident and WCA, with no City involvement.
9. In the case that an adopting party is no longer able or willing to maintain the subject
tree(s) specified in this covenant, that adopting party has the ability to transfer the
annual maintenance responsibility to another property owner listed below. This transfer
opportunity is at the adopting party's sole discretion. To effectuate this transfer, the
adopting party shall provide the City with written consent from one of the property
owners listed below, agreeing to maintain the tree(s) as specified herein. Once this is
received, the City shall require the adopting party to sign and notarize a new agreement.
The City will then record that new agreement on the new adopting party's property with
the Los Angeles County Assessor's office. The City will also record a cancellation on

the original owner's property, indicating that they are no longer responsible for
maintaining the subject tree(s). As determined by the Planning Commission in
approving CTRP2008-00031, and per Municipal Code Sections 17.76.100.F.1.c.iv and
17.76.100.G.1, only owners of the following properties are eligible to adopt one or more
of the City Trees designated in this Resolution as Tree Nos. 1-3 and 5-10:
