PC RES 2009-013 P.C. RESOLUTION NO. 2009-13 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHOL VERDES FINDING THAT THE ITYS CAPITAL IMPROVEMENTS PL (CIP), IS CONSISTENT IT THE AL POLICIES F THE RANCHO PALOSVERDES GENERAL PLAN WHEREAS, Sections 65103 & 65401 of the California Government Code require that the Planning Commission review the City's Capital Improvements Program for its conformance with the City's General Plan; and, WHEREAS, the City has prepared a draft Capital Improvements Plan (CIP)as part of its budget, and the CIP represents the City's 5-year program for prospective capital improvements for creating, maintaining, and funding present and future infrastructure requirements. The CIP addresses the City's needs relating to the acquisition, expansion, and rehabilitation of long-lived facilities and infrastructure; and, WHEREAS, on May 5, 2009, the City Council forwarded the draft Capital Improvements Plan (CIP),to the Planning Commission for consideration of a General Plan Consistency finding to determine its conformity with the City's General Plan; and, WHEREAS, the Planning Commission conducted a hearing on May 12, 2009, at which time all interested parties were given an opportunity to be heard and present evidence, and a decision was rendered on that same date. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: action 1 m The Rancho Palos Verdes Planning Commission hereby finds that the Capital Improvements Plan (CIP) is consistent with the Rancho Palos Verdes General Plan with regards to the goals and objectives of the General Plan Natural Environment, Socio/Cultural, Urban Environment, Infrastructure, Safety, Land Use, and Fiscal Elements. action 2e The Rancho Palos Verdes Planning Commission hereby finds that the Capital Improvements Plan (CIP) conforms to the City's General Plan. Section 3. Any interested person aggrieved by this decision or by any portion of this decision may appeal to the City Council. Pursuant to Section 17.80.070 of the Rancho Palos Verdes Municipal Code, any such appeal must be filed with the City, in writing, setting forth the grounds of the appeal and any specific actions requested by the appellant, and accompanied by the appropriate appeal fee, no later than fifteen (15) days following May 27, 2009, the date of the Planning Commission's final action. Section 444 For the foregoing reasons and based on the information and findings included in the Staff Report, Minutes and all other records of the proceedings, which are attached hereto and made a part thereof by reference, the Planning Commission hereby finds that the City's Capital Improvement Plan (CIP) is consistent with the goals and policies of the Rancho Palos Verdes General Plan.
