RESOLUTION NO. 2007 68 A RESOLUTION OF THE PLANNING COMMISSION F THE CITY OF RANCHO PALOS VERDES DENYING THE APPEAL AND UPHOLDING THE DIRECTOR'S APPROVAL OF A CITY TREE REVIEW PER IT TO ALLOW THE REMOVAL OF 2 TWO SYCAMORE TREES IN THE PUBLIC RIGHT-OF-WAY, ADJACENT TO 29040 PALOS VERDES DRIVE EAST. WHEREAS, on May 9, 2007, the applicants (property owners of 28971, 28973 and 28975 Palos Verdes Drive East) submitted an application for a City Tree Review Permit (Case No. CTRP2007-00018), a request to remove 2 Sycamore trees in the public right-of-way adjacent to 29040 Palos Verdes Drive East; and, WHEREAS, on September 18, 2007, a written notice of the Director's decision to remove the subject trees was mailed out to the applicants, ten closest adjacent properties including the property directing abutting the public right-of-way where the subject tree is located; and, WHEREAS, on September 24, 2007, the property owner of 29040 Palos Verdes Drive East (Mr. Kluck) submitted a letter of concern disagreeing with the Director's decision; and, WHEREAS, on October 8, 2007, the Director mailed out a final notice of decision to remove the subject trees was mailed out to the applicants, ten closest adjacent properties including the property directing abutting the public right-of-way where the subject tree is located; and, WHEREAS, on October 22, 2007, Mr. Kluck submitted an appeal to overturn the Director's decision; and, WHEREAS, after noticed issued on October 24, 2007 pursuant to the requirements of the Rancho Palos Verdes Development Code, the Planning Commission held a duly noticed public hearing on December 11, 2007, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That the appeal is not warranted because it is determined that the 2 Sycamore trees in the public right-of-way are significantly impairing a view from a viewing area of 28971, 28973 and 28975 Palos Verdes Drive East properties. 28971 Palos Verdes Drive East (Egan) — The subject trees are located on the left side of the entire view frame and significantly impair the view of the Harbor, ocean and possibly Vincent Thomas Bridge. 28973 Palos Verdes Drive East (de Langis)—The subject trees are located on the far left side of the entire view frame and significantly impair the view of the Harbor, ocean and city lights. 28975 Palos Verdes Drive East (Trull) —The subject trees are located in the center of the entire view frame and significantly impair the view of the Harbor, ocean and city lights. Section 2: Any interested person aggrieved by this decision or any portion of this decision may appeal to the City Council. The appeal shall set forth the grounds for appeal and any specific action being requested by the appellant. Any appeal letter must be filed within fifteen (15) calendar days of the date of this decision, or by 4:30 PM on Friday,, January 4, 2008. A $1,344.00 appeal fee must accompany any appeal letter. If no appeal is filed timely, the Planning Commission's decision will be final at 4:30 PM on January 4, 2008. The appeal period has been extended to January 4, 2008 due to City Hall offices being closed during the holidays. Section : For the foregoing reasons and based on the information and findings included in the Staff Report, the Planning Commission of the City of Rancho Palos Verdes hereby denies the appeal and upholds the Director's approval of a City Tree Review Permit to allow the removal of 2 Sycamore trees in the public right-of-way, adjacent to 29040 Palos Verdes Drive East.
