WHEREAS, Section 65402(b) of the California Government Code requires that a
county shall not acquire real property, nor dispose of any real property, nor construct or
authorize a public building or structure, within the corporate limits of a city, if such city has
adopted a general plan and such general plan is applicable thereto, until the location,
purpose and extent of such acquisition, disposition, or such public building or structure
have been submitted to and reported upon bythe planning agency having jurisdiction,as to
conformity with said adopted general plan; and,
WHEREAS, on January 17, 2007, the County of Los Angeles submitted a request
for a general plan consistency finding for the 3-year renewal of the County's license with
the U.S. Coast Guard for the Point Vicente Bunker Communications Facility, located at
Point Vicente Park and Civic Center in the City of Rancho Palos Verdes; and,
WHEREAS, pursuant to the provisions of the California Environmental Quality Act,
Public Resources Code Sections 21000 et. seq. ("CEQA"), the State's CEQA Guidelines,
California Code of Regulations, Title 14, Section 15000 et. seq., the City's Local CEQA
Guidelines, and Government Code Section 65962.5(f)(Hazardous Waste and Substances
Statement),the City of Rancho Palos Verdes reviewed the request and determined that the
proposed request would not have a significant impact on the environment and has,
therefore, been determined to be categorically exempt (Class 1, Section 15301); and,
WHEREAS, the Planning Commission conducted a hearing on February 13, 2007,
within forty(40)days of the date the request was submitted by the County of Los Angeles,
at which time all interested parties were given an opportunity to be heard and present
evidence.
NOW,THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: The Rancho Palos Verdes Planning Commission hereby finds as
follows with respect to the location, purpose and extent of the renewal of the County's
license with the U.S. Coast Guard for the Point Vicente Bunker Communications Facility:
A. The location of the license renewal is consistent with the Rancho Palos Verdes
General Plan. The antenna tower and communications bunker already exist on the
Point Vicente Park and Civic Center site. The underground bunkerwas constructed
in 1942 and the 70-foot-tall antenna tower was erected at a later unknown date,
presumably prior to the City's incorporation in 1973. The antenna tower and the
bunker appear to be consistent with the development standards of City's `I'
(Institutional)zoning district. Furthermore, the continued use of these facilities does
not conflict with the property's Recreational-Passive land use designation from the
City's General Plan.
B. The purpose of the license renewal is consistent with the Rancho Palos Verdes
General Plan. This renewal would allow for continued use of the antenna tower and
bunker for emergency communications by the County Sheriff's and Fire
departments. These facilities serve the City of Rancho Palos Verdes and other
communities on the Peninsula. Several Safety Policies in the City's General Plan
support the renewal of the license between the County and USCG, which would
serve to ensure back-up law enforcement assistance in emergency situations;
encourage the availability of paramedic rescue service; and maintain liaisons with
other local, County, State and Federal disaster agencies.
C. The extent of the license renewal is consistent with the Rancho Palos Verdes
General Plan. The antenna tower and communications bunker on the Point Vicente
Park and Civic Center site have existed on the U.S. Coast Guard property for many
years and the renewal of the County's license does not in any way alter the physical
characteristics of these site improvements. Furthermore,the renewal of the license
agreement does not result in the expansion of the current use of the facilities.
Section 2: Any interested person aggrieved by this decision or by any portion of
this decision may appeal to the City Council. Pursuant to Section 17.80.070 of the Rancho
Palos Verdes Municipal Code, any such appeal must be filed with the City, in writing,
setting forth the grounds of the appeal and any specific actions requested by the appellant,
and accompanied by the appropriate appeal fee, no later than fifteen (15) days following
February 13, 2007, the date of the Planning Commission's final action.
Section 3: For the foregoing reasons and based on the information and findings
included in the Staff Report, Minutes and all other records of the proceedings, which are
attached hereto and made a part thereof by reference, the Planning Commission hereby
forwards to the Board of Supervisors of the County of Los Angeles a finding that the
renewal of the license with the U.S. Coast Guard for the County's Point Vicente Bunker
Communications Facility, located at 30950 Hawthorne Boulevard, is consistent with the
goals and policies of the Rancho Palos Verdes General Plan.
