PC RES 2006-050 P.C. RESOLUTION NO. 2006-50 RESOLUTION F THE PLANNING COMMISSION THE CITY OF RANCHO PALPALOS VERDES DENYINGWITHOUT PREJUDICE CASE NO. Z 2 013 ,A HEIGHT VARIATION FOR A 795 SQUARE FT ONE- STORY ADDITION AND AN 815 SQUARE FOOT SECOND-STORY ADDITION TO AN EXISTINGONE STORY RESIDENCE, RESULTING IN A 3,997 SQUARE FOOT STRUCTURE MEASURING 23.38-FEET IN OVERALL HEIGHT, T PROPERTY LOCATED T 4941 BLACKHORSE WHEREAS, on March 2, 2006,the applicant submitted Case No.Z®N2006-00136, a Height Variation application for an 815 square foot one-story addition and a 960 square foot second-story addition to an existing one-story residence; and, WHEREAS, on March 31, 2006, the project was deemed incomplete pending submittal of additional information; and, WHEREAS, upon submittal of the required information, the construction of the temporary silhouette and submittal of the silhouette certification form, the case was deemed complete by Staff on May 25, 2006; and, WHEREAS, pursuant to the provisions of the California Environmental Quality Act, Public Resources Code Sections 21000 et. seq. ("CEQA"), the State's CEQA Guidelines, California Code of Regulation, Title 14, Section 15000 et. seq., the City's Local CEQA Guidelines, and Government Code Section 65962.5(f)(Hazardous Waste and Substances Statement), Staff found no evidence that Case No. ZON2006-00136 would have a significant effect on the environment and, therefore, the proposed project has been found to be categorically exempt under Class 1 (Existing Facilities)since the project involves an addition to an existing residence; and, WHEREAS, after notice issued pursuant to the requirements of the Rancho Palos Verdes Development Code, the Planning Commission held a duly noticed public hearing on July 11, 2006, at which time all interested parties were given an opportunity to be heard and present evidence; and, WHEREAS, after notice issued pursuant to the requirements of the Rancho Palos Verdes Development Code, the Planning Commission held a duly noticed public hearing on July 11, 2006, at which time the Planning Commission directed the applicant to redesign the project to address privacy concerns and bulk and mass caused by the proposed project, and continued the item to the September 12, 2006 meeting; and, WHEREAS, the Planning Commission held a duly noticed public hearing on September 12, 2006, at which time the Planning Commission directed the applicant to redesign the project to address the proposed size concerns and to reconstruct the silhouette, and, WHEREAS,the Planning Commission held a duly noticed public hearing on October 10, 2006, at which time all interested parties were given an opportunity to be heard and present evidence; and, NOW,THEREFORE,THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: The proposed project will not be compatible with the character of the immediate neighborhood due to the resulting structure size and the bulk and mass of the structure. The resulting structure size will be significantly larger than the structure size range in the immediate neighborhood, and significantly larger than the average structure size. By concentrating the second-story addition near the center of the new first-story footprint, the resulting residence will contain a massive appearance along the most visible portions of the structure, inconsistent with the designs found in the neighborhood. Section 2: For the foregoing reason and based on the information and findings included in the Staff Report, Minutes and other records of proceedings, the Planning Commission of the City of Rancho Palos Verdes hereby denies without prejudice Case No. ZON2006-00136 for a Height Variation. Section 3: Any interested person aggrieved by this decision or by any portion of this decision may appeal to the City Council. Pursuant to Section 17.80 of the Rancho Palos Verdes Municipal Code, any such appeal must be filed with the City, in writing stating the grounds of the appeal and with the appropriate appeal fee, no later than 5:30 P.M. on October 25, 2006.
