AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES
AMENDING THE 1997 EDITION OF THE UNIFORM ADMINISTRATIVE
CODE, AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE
AND DECLARING THE URGENCY THEREOF
THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES
DOES ORDAIN AS FOLLOWS:
SECTION 1. Notwithstanding the provisions of Section 15.18.010 of
Chapter 15.18 of Title 15 of the Rancho Palos Verdes Municipal Code, Section
15.18.090 of Chapter 15.18 of Title 15 of the Rancho Palos Verdes Municipal Code is
hereby amended by amending Section 310 of the Administrative Code to add a new
sub-section 310.5 thereto to read as follows:
"310.5 Hazard Eliminated. A certificate of occupancy or permit under this title
may be issued only if the reports required by Section 310.3 contain sufficient
information to satisfy the Building Official that all geological or geotechnical
hazards will be eliminated, prior to use or occupancy of the land or structure, by
modification of topography, reduction of subsurface water, buttresses, or by
other means or combination of means sufficient to provide a factor of safety of
not less than 1.5."
SECTION 2. The City Council hereby finds that the modifications to the
Administrative Code are necessary to reinstate a provision that was inadvertently
omitted when the City's Administrative Code was amended recently. It is necessary to
restore this Section immediately so that construction will not occur in areas of the City
where it would be dangerous to build new structures. In the absence of immediate
effectiveness, the provisions of this Ordinance will not be in place, and this will have a
detrimental effect on the public, health, safety and welfare. This modification to the
Code contains vital provisions regarding administrative procedures, necessitated by the
City's proximity to active earthquake fault zones and the existence of historic and active
landslides within the City. For these reasons, the public health, safety and welfare
require that this ordinance take effect immediately upon adoption.
SECTION 3. Because the extent the provisions of this Ordinance are
substantially the same as previous provisions of the Rancho Palos Verdes Municipal
Code, these provisions shall be construed as continuations of those provisions and not
as new enactments.
SECTION 4. If any section, subsection, subdivision, paragraph, sentence,
clause or phrase of this Ordinance or any part hereof is for any reason held to be
invalid, such invalidity shall not affect the validity of the remaining portions of this
Ordinance or any part thereof. The City Council of the City of Rancho Palos Verdes

hereby declares that it would have passed each section, subsection, subdivision,
paragraph, sentence, clause or phrase hereof, irrespective of the fact that any one or
more sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases
be declared invalid.
SECTION 5. This ordinance is an urgency ordinance that was adopted by
a unanimous vote of the City Council and became effective immediately upon
adoption.
