ORD 348 ORDINANCE NO. 348 AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES APPROVING SPECIFIC PLAN AMENDMENT NO. 10—AN AMENDMENT TO SPECIFIC PLAN III (29505-29701 WESTERN AVENUE). WHEREAS, on October 19, 1998, the project applicant, Rich Development Company, with approval of the property owner Tosco Corporation, submitted applications for Specific Plan Amendment No. 10, Conditional Use Permit No. 204, and Grading Permit No. 2044 to the City; and, WHEREAS, pursuant to the provisions of the California Environmental Quality Act, Public Resources Code Sections 21000 et. seq. ("CEQA"), the State CEQA Guidelines, California Code of Regulations, Title 14, Sections 15000 et. seq., the City's Local CEQA Guidelines, and Government Code Section 65952.5(e) (Hazardous Waste and Substances Statement), the City of Rancho Palos Verdes prepared an Initial Study and determined that, there is no substantial evidence that the approval of Specific Plan Amendment No. 10, Conditional Use Permit No. 204 and Grading Permit No. 2044 would result in a significant adverse effect on the environment. Accordingly, a Draft Mitigated Negative Declaration has been prepared and notice of that fact was given in the manner required by law; and, WHEREAS, the Initial Study was prepared on March 24, 1999 and distributed for circulation and review from March 24, 1999 through April 22, 1999; and, WHEREAS, copies of the draft Mitigated Negative Declaration were distributed to the Planning Commission, and prior to taking action on the proposed Specific Plan Amendment No. 10, Conditional Use Permit No. 204 and Grading Permit No. 2044, the Planning Commission independently reviewed and considered the information and findings contained in the Mitigated Negative Declaration and determined that the document was prepared in compliance with the requirements of CEQA and local guidelines, with respect thereto, and on April 27, 1999 adopted P.C. Resolution No. 99-12, recommending City Council adoption of the Mitigated Negative Declaration; and, WHEREAS, on April 27, 1999, the Planning Commission also adopted P.C. Resolution No. 99-13, recommending City Council approval of Specific Plan Amendment No. 10, Conditional Use Permit No. 204 and Grading Permit No. 2044; and, WHEREAS, copies of the draft Mitigated Negative Declaration were distributed to the City Council, and prior to taking action on the proposed Specific Plan Amendment No. 10, Conditional Use Permit No. 204 and Grading Permit No. 2044, the City Council Ordinance No. 348 Page 1 of 3 independently reviewed and considered the information and findings contained in g the Mitigated Negative Declaration and determined that the document was prepared p p ed �n compliance with the requirements of CEQA and local guidelines, with respect thereto; and, , WHEREAS, after issuing notice pursuant to the requirements of the City's q Y Development Code and the State CEQA Guidelines, the City Council of the City of Rancho Y y Palos Verdes held a public hearing on June 1, 1999, at which time all interested parties . p were given an opportunity to be heard and present evidence; and WHEREAS, the City Council adopted Resolution No. 99-38, adopting the p g Mitigated Negative Declaration for Specific Plan Amendment No. 10 Conditional Use Permit No. 204 and Grading Permit No. 2044, and adopted Resolution No. 99-39, p approving Conditional Use Permit No. 204 and Grading Permit No. 2044, which are related to Specific Plan Amendment No. 10 as described herein. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY ORDAIN AS FOLLOWS: Section 1: This approval is for an Amendment to Specific Plan No. III to modify the development standards for one specific parcel of land within the Specific Plan No. III, , located at 29701 Western Avenue, to permit a 6' minimum front (along and Y Western Avenue) setback, a 5' minimum side yard (south side) setback, and a 0' landscape buffer required along the south and westerly property lines. Section 2: Specific Plan Amendment No. 10 is consistent with the General Plan and Specific Plan III for Western Avenue, as it does not alter the existing land use of the subject site, and is consistent with various goals and policies of the General Plan and Specific Plan III; including, recognizing the "opportunities available to the area while eliminating or reducing the constraints that the area faces'; such as recognizing that the g g existing lot located at 29701 Western Avenue is constrained by the combination of its size and configuration and the existing development standards of Specific Plan III - thereby amending the development standards to recognize the opportunities available to this specific lot. Section 3: The revised development standards for the subject ro ert located p p Y at 29701 Western Avenue can be approved for this specific lot because this lot is different and has more constraints than other parcels within Specific Plan III, such as existing site conditions (lot size, need for intersection improvements, access easements) and existing development standards (building setbacks). Section 4: The time within which the judicial review of the decision reflected in this Resolution, if available, must be sought is governed by Section 1094.6 of the California Code of Civil Procedure. Ordinance No. 348 Page 2 of 3 Section 5: Based upon the facts contained in this Ordinance, in the Staff components Report and other onents of the legislative record, in the adopted Negative p p Declaration, and in the public comments received by the Planning Commission and the City Council, the City Council hereby approves Specific Plan Amendment No. 10 amending Specific Plan III, to change the development standards for the subject property located at 29701 Western Avenue, by adding a new paragraph to Section VI.A.3.a, to read as follows, "Not withstanding the foregoing, the following standards shall apply to the lot that is commonly referred to as 29701 Western Avenue: a 6'front yard (along Western Avenue) building setback, a 5'minimum side yard (south side) building setback, and a 0'landscape buffer along the south and westerly property lines" Section 6: The City Council hereby directs the City Clerk to cause the changes set forth herein to be made to the Official Specific Plan III document.
