ORD 325U ORDINANCE NO. 325 U AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES EXTENDING THE TIME TO REGISTER NONCONFORMING USES AND STRUCTURES LOCATED IN THE EQUESTRIAN OVERLAY (Q) DISTRICT, AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE AND DECLARING THE URGENCY THEREOF. THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES ORDAIN AS FOLLOWS: Section 1. The first paragraph of Section 17.46.080 of Chapter 17.46 of Title 17 of the Rancho Palos Verdes Municipal Code is hereby amended by amending the last sentence thereof to read as follows: "The written statement shall be filed with the director by October 3, 1997." Section 2. Urgency Findings. Chapter 17.46 contains provisions by which the majority of non-conforming uses and structures that were legal as of February 1, 1997, could be registered with the City's Department of Planning, Building and Code Enforcement so that these uses and structures could continue in perpetuity. The deadline by which the non-conformity statements must be filed with the City was July 15, 1997. Despite that the adoption of the revisions to the City's Development Code, which included Chapter 17.46, was well-publicized in the City, and despite that the City published notice of the deadline to submit non-conformity statements in the newspaper and on the cable television reader board and sent courtesy notices regarding the deadline to the Peninsula Horsemen's Association, the homeowners' associations within the equestrian overlay control districts and to all persons who had expressed an interest in the revisions to the Chapter of the Code containing the Equestrian Overlay Control District, only a few non-conformity statements have been received by the City. Thus, many individuals owning properties within the Equestrian Overlay District that contain certain non-conforming uses or structures have not availed themselves of the opportunity to submit non-conformity statements to the City. The City Council finds that it is beneficial to the rights of individuals owning properties within the Equestrian Overlay Control District to extend the deadline to file non-conformity statements to October 3, 1997. Accordingly, the City Council finds that it is necessary for this ordinance to become effective immediately so that the deadline will be extended which will preserve the public health, safety and welfare. Based on these facts constituting the urgency, and passed by a four-fifths vote of this City Council, this Ordinance is adopted immediately upon introduction pursuant to Government Code Section 36934 and shall take effect immediately upon its adoption pursuant to Government Code Section 36937(b).
