ORD 315U ORDINANCE NO. 315U AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES REGARDING THE PROCESSING OF CERTAIN COASTAL PERMITS, AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE, AND DECLARING THE URGENCY THEREOF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES ORDAIN AS FOLLOWS: SECTION 1: Section 17. 67.040 8 of Chapter 17. 67 of Title 17 of the Rancho Palos Verdes Municipal Code is hereby amended by amending paragraph 1 thereof to read as follows: 1. At least ten (10) calendar days prior to the first public hearing on an appealable development proposal, the city shall provide notice by first-class mail of the pending application. This notice shall be provided to: a. Each applicant; b. All persons who have supplied self-addressed, stamped envelopes for that development project or for coastal decisions within the city; c. All property owners and residents within one hundred feet of the perimeter of the parcel on which the development is proposed; and d. The Coastal Commission. SECTION 2: Section 17. 67.040 C of Chapter 17.67 of Title 17 of the Rancho Palos Verdes Municipal Code is hereby amended to read as follows: C. Nonappealable Developments with Hearing. Notice of nonappealable developments within the coastal district that require a public hearing under city ordinances shall be provided in accordance with existing city notice requirements incorporating the following criteria: At least ten (10) calendar days prior to the public hearing, the city shall provide notice by first- class mail of the pending application. This notice shall be provided to: 1. All persons who have supplied self-addressed, stamped envelopes for notice of that development project or for coastal decisions in the city; 2 . All property owners within one hundred feet of the perimeter of the proposed development; 3 . All residents within one hundred feet of the perimeter of the proposed development; and 4. The Coastal Commission. 960529 R6876-00001 cwl 0691750 Additionally, notice of the proposed development shall be published in a newspaper of general circulation. The notice shall contain a statement that the proposed development is within the coastal district. SECTION 3: Section 17. 67.050 of Chapter 17. 67 of Title 17 of the Rancho Palos Verdes Municipal Code is hereby amended to read as follows: 17. 67. 050 Public hearing. A. At least one public hearing shall be held on each of the following applications: (1) for an appealable development, or (2) for a nonappealable development which requires a public hearing pursuant to Section 17. 67. 040 C, thereby affording any persons the opportunity to appear at the hearing and inform the city of the nature of their concerns regarding the project. The public hearing shall be conducted by the hearings officer, the planning commission, or by the city council when the application satisfies the criteria of Paragraph C of this Section 17. 67. 050. B. Applications for coastal permits for nonappealable developments which do not require a public hearing under the provisions of this Chapter, but which do require a public hearing pursuant to another city ordinance, may be heard concurrently with the other development application. C. To expedite review of an application, the city council may conduct the public hearing thereon, without having the application heard first by the hearings officer or the planning commission, when the purpose of the application for a coastal permit is: (1) to conduct geotechnical or geological investigations including, but not limited to, associated site preparation or similar work, and construction of access or other improvements necessary to the investigations; (2) to perform landslide remediation work including, but not limited to, grading and installation of drainage improvements; or (3) to maintain access or essential public services. SECTION 4: Urgency Findings. The Coastal Act provides that the City is required to conduct one public hearing on certain applications for coastal permits. As presently drafted, the Rancho Palos Verdes Municipal Code complies with the Coastal Act and, in addition, provides opportunities for appeal with hearings at each appellate level. This process is time consuming and is having a detrimental impact on certain projects which are necessary to protect the public health and safety and, accordingly, should be performed as soon as possible but do not qualify for the issuance of an emergency coastal permit. This situation is detrimental to the general public and to applicants 960529 R6876-00001 cwl 0691750 - 2 - Ordinance No. 315U and projects which currently are being processed by the City because of the delay which results from processing appeals prior to final action by the City Council. This urgency ordinance eliminates that unnecessary delay in processing applications for certain specified projects which will provide important geotechnical information and will allow landslide remediation work to be performed. Therefore, this Ordinance must become effective immediately to preserve the public peace, health and safety by having procedures in place which will allow the City to process these applications promptly and without unnecessary delay. Based on these facts constituting the urgency, and passed by a four-fifths vote of this City Council, this Ordinance is adopted immediately upon introduction pursuant to Government Code Section 36934 and shall take effect immediately upon its adoption pursuant to Government Code Section 36937 (b) . SECTION 5: The City Clerk shall certify to the adoption of this ordinance and shall cause the same to be published or posted in the manner prescribed by law.
