ORD 220 ORDINANCE NO. 220 AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES AMENDING ORDINANCE NO. 213U. THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES ORDAIN AS FOLLOWS : Section 1 : Section 1 of Ordinance 213U, as amended by Ordinances No . 214U, and No . 216U, is amended to read as follows : "Section 1 : Every person owning or controlling property in the coastal zone upon which a commercial recreational use is located , as defined in Chapter 17 . 24 of the Rancho Palos Verdes Municipal Code , shall comply with the following requirements if said commercial recreational use is discontinued , reduced or its operation modified . a) All buildings and other structures shall remain unboarded and in all respects appear to be occupied . Any existing or proposed sign (s) shall be subject to Chapter 17 .52 of the Development Code . b) No chain link or other fence or structure shall be erected to prevent normal entry upon the property except as necessary to protect the health and safety of the general public during the course of demolition or construction approved pursuant to this Ordinance . c) All landscaping activities and ground maintenance shall be continued as if the use remained viable and operating . d) All previously existing parking for and access to the coastal zone shall be maintained in the same manner and to the same extent as when the use was operating except as necessary to preserve the health and safety of the general public during the course of demolition or construction approved pursuant to this Ordinance . e) Adequate security personnel shall be provided to ensure that the property will not become vandalized or pose a safety hazard . Such personnel shall not restrict any established coastal access . f) No new use may be established , nor may the commercial recreational use be re-established, unless a Conditional Use Permit is first obtained pursuant to Chapter 17 . 56 of Article VII of Title 17 of the Rancho Palos Verdes Municipal Code . Demolition and removal of existing structures including buildings , utilities , and paved surfaces may proceed prior to approval of a CUP for the property provided : ( 1 ) a report identifying structures to be demolished and documenting the justification for demolition is submitted to the City and approved by the Director of Environmental Services ; and (2) a demolition plan is submitted to the City and approved by the Director of Environmental Services which identifies all structures proposed for demolition, documents all plant materials with a caliper of 3 inches or more which will be removed . sets forth a program for storage and re-use on-site of significant plant materials which must be removed to facilitate demolition, and describes the provision for removal and disposition of all debris resulting from the demolition and designates a parking , access and circulation program to be utilized during such activities specified in the plan. All demolition shall be in accordance with Section 302 of the Building Code . The report and plan shall bY e approved by the Director if he finds that the only work to be performed pursuant to the report is based upon: (i) identified structural conditions which are inadequate to ensure and acceptable margin of safety; (ii) functional obsolescence; and (iii) lack of potential for reuse or interim use . g) The owner , agent or person having the beneficial use of buildings or other structures covered by this Ordinance shall submit a written plan of the anticipated future use of the site including the building use and scale of operation to the Director of Environmental Services within 30 days after said use is discontinued , reduced or modified.
