AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES
PLACING A MORATORIUM ON THE ESTABLISHMENT OF NEW
USES FOR THE SALE OF FOOD AND SUNDRY ITEMS UNDER
CERTAIN CIRCUMSTANCES AND DECLARING THE URGENCY
THEREOF
THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES ORDAIN AS FOL-
LOWS:
Section 1: No person shall commence or establish a new primary or
ancillary use for the sale of food and sundry grocery items, nor shall a
conditional use permit, variance, building permit or any other authoriza-
tion to commence such use be issued in connection with parcels of 30,000
square feet or less located within three hundred feet of property used or
zoned for residential purposes. This prohibition shall apply to the com-
mencement or establishment of a new ancillary use for the sale of food and
sundry grocery items in connection with the sale of gasoline on lots of
such size and location.
Section 2: The City has recently received increasing numbers of appli-
cations for mini-markets located on small lots near residential neighbor-
hoods. Such applications pose an immediate threat to the health, safety
and welfare of persons residing in neighborhoods adjacent to such proposed
uses. This threat is posed by the crime committed by persons loitering at
such establishments , noise, and traffic congestion. This ordinance will
prohibit the establishment of such uses until the City has sufficient time
to develop adequate safeguards to protect the adjacent residential neigh-
borhoods. This ordinance is therefore necessary for the immediate preser-
vation of the public health, safety and welfare and shall take effect
immediately upon its adoption. This ordinance shall expire 45 days from
the date of adoption unless extended following a public hearing. I
