AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES
PROHIBITING COMMERCIAL DEVELOPMENT ALONG A PORTION
OF WESTERN AVENUE AND ESTABLISHING THE URGENCY
THEREOF
THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES ORDAIN AS
FOLLOWS:
Section 1: All property zoned Commercial General and located between
29505 and 29701 South Western Avenue (inclusive) outlined in red on Exhi-
bit "A" of this Ordinance shall be subject to this Ordinance.
Section 2: No application for a Conditional Use Permit, Variance or
any other development application involving an addition expansion or alter-
nation of 500 square feet or more to an existing structure (excluding in-
terior remodeling) or for new development shall be accepted, processed or
issued by the City.
Section 3: The City of Rancho Palos Verdes has recently adopted Gen-
eral Plan and Zoning land use designations for the "Eastview" annexation
area. In establishing the Commercial General zoning designation for the
above defined area along Western Avenue, the City Council determined that a
series of Specific Plans should be enacted to best address the unique and
varying characteristics of the Commercial General zone. Until such time as
this Specific Plan is enacted for the above defined area, a moratorium to
prohibit development which might be contrary to the goals and policies of
the General Plan is necessary. If this moratorium is not enacted, the pro-
perty could be developed in a manner which could cause an immediate threat
to the public health, safety and general welfare. This Ordinance will pro-
hibit development which is contrary to the General Plan, is necessary for
the health, safety and general welfare, shall take effect immediately upon
its adoption, and shall be of no further force and effect 45 days follow-
ing the effective date hereof unless extended by the City Council pursuant
to Section 65858 of the California Government Code,
PASSED, APPROVED and ADOPTED on December 17, 1985.
