ORD 195 ORDINANCE NO. 195 AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES REVISING REGULATIONS FOR SOLICITATION AND AMENDING THE RANCHO PALOS VERDES MUNCIPAL CODE. THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY ORDAIN AS FOLLOWS SECTION 1: Chapter 5.08 of Title 5 of the Rancho Palos Verdes Municipal Code is amended by adding Section 5.08.40 to read: 5.08.40. Sections 607 to 610 of Article 12 of Chapter II and Chapter XVIII Repealed. Notwithstanding the provisions of Section 5.08.101 , Sections 607, 608, 609 and 610 of Article 12 of Chapter II and Chapter XVIII of the License Ordinance are hereby repealed. SECTION 2: Title 5 of the Rancho Palos Verdes Municipal Code is amended by adding Chapter 5.20, entitled Solicitation, to read as follows: CHAPTER 5.20 SOLICITATION SECTION 5.20.010. Definitions. A. "Solicit" and "solicitation" mean the request, directly or indirectly, of money, credit, property, financial assistance, patronage or other things of value, hawking, peddling, or vending for charitable (as defined in this section) or commer- cial purposes or otherwise, or the dissemination of information or ideas, conducted door to door, in any place of public accommodation, in any place of business open to the public generally, on the city streets and sidewalks, in the public parks, on the public beaches, or in any public places. These words also mean and include the fol- lowing methods of disseminating information, securing such money, patronage, credit, property, financial assistance or other thing of value, when conducted in the fol- lowing manner: 1. Any oral or written request; 2. The distribution, circulation, posting or publishing of any handbill, written advertisement or other publication, unless such handbill or written s advertisement has been placed within a business open to the public generally with the express permission of the owner or lessee of such business; 3. The sale of or taking orders for any goods, services, merchandise, wares or other tangible items. A solicitation, as defined in this subsection, shall be deemed completed when made, whether or not the person making the same receives any contribution or makes any sale referred to in this subsection. 703CP/ORD1.1-3 1 Ordinance No. 195 B. "Charitable" means and includes the words patriotic, philanthropic, social services, welfare, benevolent, educational, religious, civic or fraternal, either actual or purported. C. "City" means the City of Rancho Palos Verdes. D. "Contributions" means and includes the words alms, food, clothing, money, property, subscription or pledge, and also donations under the guise of loans of money or property. E. "Finance Director" means that person whose duties and responsibilities are described in Chapter 2.32 of this Code or any other City officer charged with the administration of this Chapter. F. "Person" shall means any individual, firm, business, co-partnership, cor- poration, company, association, joint stock association, church, religious sect, religious demonination, society, organization, or league and shall include any trustee, receiver, assignee, agent, solicitor, or other similar representative thereof. SECTION 5.20.020. Manner of Solicitation. A. No person shall solicit at any dwelling, including but not limited to a house, apartment, or condominium where there is a sign indicating "No Solicitations", "Do Not Disturb", or any other indication that the occupants do not wish to be soli- cited or in any other way have their privacy disturbed; B. No person shall touch, come into physical contact with, or affix any object to the person of any member of the public, without first receiving express permission therefor from such member of the public; C. No person shall persistently and importunately solicit any member of the public after such member of the public expresses his or her desire not to be soli- cited; D. No person shall intentionally and deliberately obstruct the free movement 'of any person on any street, sidewalk or other place or in any place open to the public generally; E. No person shall solicit from a captive audience. "Captive Audience" shall be defined a purposefully stationary persons, such as persons in lines or seated in public areas; F. No person shall threaten any injury or damage to any member of the public who declines to be solicited; G. No person shall accept food stamps as a contribution, and; H. No person shall misrepresent his or her physical or mental health while soli- citing. SECTION 5.20.030. Time of Solicitation. It shall be unlawful for any person to go upon private residential premises after 9:00 P.M. or earlier than 8:00 A.M. for 703CP/ORD1.1-3 2 Ordinance No. 195 the purpose of solicitation, unless such person has been requested or invited to do so by the owner or occupant of said premises. This section shal not be interpreted to grant any person permission to enter upon private property. SECTION 3. Severability. It is the intention of the City Council that each separate provision of this Chapter shall be deemed independent of all other provi- sions herein, and it is further the intention of the City Council that if any provi- sion of this Chapter is declared invalid, other provisions thereof shall remain valid and enforceable. GULUZZY REGULATIONS FOR SOLICITATION WITHIN THE CITY OF RANCHO PALOS VERDES A license is not required for solicitation by the City of Rancho Palos Verdes; however, the following guidelines must be adhered to at all times: 1. No person shall solicit after 9: 00 P.M. or earlier than 8:00 A.M. unless invited to do so by the owner or occupant of said premi- ses. 2 . No solicitation may occur where a sign indicating "No Solicita- tion" , "Do Not Disturb" or any other indication that the occu- pants do not want to be solicited appears. 3 . Permission, must be granted before any solicitor shall touch, come into physical contact with, or affix any object on any per- son. 4 . No soliciting may take place once a person expresses his/her desire not to be solicited. 5. No solicitor may obstruct the free movement of any person on any street, sidewalk or any other place. 6. No person shall solicit from a captive audience. Examples of captive audiences are persons in lines or seated in public areas. 7. No person shall threaten any injury or damage to any member of the public who declines to be solicited. 8. No person shall accept food stamps as a contribution. 9. No person, while soliciting, shall misrepresent his/her physical and/or mental health. 10 .
