ORD 190 ORDINANCE NO. 190 AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES ADOPTING A REDEVELOPMENT PLAN AS THE OFFICIAL REDEVELOPMENT PLAN FOR PROJECT AREA NO. 1 THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES ORDAIN AS FOLLOWS: Section 1. The purposes and intent of the City Council with respect to Project Area No. 1 (the "Project Area" ) of the Rancho Palos Verdes Redevelopment Agency are to eliminate the conditions of blight existing in the Project Area and to prevent their recurrence by undertaking all appropriate redevelopment projects pursuant to the Community Redevelopment Law, California Health and Safety Code Section 33000, et seq. (the "Law" ) . Section 2. The Redevelopment Plan for Project Area No. 1 (the "Redevelopment Plan" ) , attached hereto as Exhibit A, is incorporated herein by this reference. Section 3. Based upon the record of the joint public hearing held on the Redevelopment Plan, the various reports and other information provided to the City Council, the City Council hereby finds and determines that: A. The Project Area is a blighted area, the redevelopment of which is necessary to effectuate the public purposes declared in the Law. B. The Redevelopment Plan would redevelop the area in conformity with the Law and in the interest of the public peace, health, safety and welfare. C. The adoption and carrying out of the Redevelop- ment P ment Plan is economically sound and feasible. D. The Redevelopment Plan conforms to the General Plan of the City of Rancho Palos Verdes . II/ E. The carrying out of the Redevelopment Plan would promote the public peace, health, safety and welfare of the City of Rancho Palos Verdes and would effectuate the ur oses P P and policies of the Law. F. The condemnation of real property is necessary to the execution of the Redevelopment Plan and adequate provisions have been made for payment for property to be acquired as provided by law. G. The Agency has a feasible method or plan for the relocation of families and persons which may displaced dis laced from the Project Area if the Redevelopment Plan may result in the temporary or permanent displacement of any occupants of housing P g facilities in the Project Area. H. There are or are being provided in the Project Area or in other areas not generally less desirable in regard to public utilities and public and commercial facilities and at rents or prices within the financial means of the families and persons who may be displaced from the Project Area, decent, safe and sanitary dwellings equal in number to the number of and available to such displaced families and persons and reasonably, accessible to their places of employment. -2- ORD. The inclusion in the Project Area of any lands, buildings or improvements which are not detrimental to the public health, safety or welfare is necessary for the effective redevelopment of the area of which they are a part; any such area included is necessary for effective redevelopment and is not included for the purpose of obtaining the allocation of tax increment revenues from such area pursuant to California Health and Safety Code Section 33670 without other substantial justification for its inclusion. J. The elimination of blight and the redevelopment of the Project Area could not reasonably be expected to be accomplished by private enterprise acting alone without the aid and assistance of the Rancho Palos Verdes Redevelopment Agency. Section 4. Based upon the record of such joint public hearing and the various reports and other information provided to the City Council, the City Council is satisfied permanent housing facilities will be available within three years from the time occupants of the Project Area may be displaced and that pending the development of such facilities, there will be available to such occupants who may be displaced adequate temporary housing facilities at rents comparable to those at the time of displacement. Section 5. Based upon the record of such joint public hearing and the various reports and other information provided to the City Council, the City Council is convinced that the effect of tax increment financing will not cause a -3- ORD. NO. 190 841112 am 0051WLS1 severe financial burden or detriment on any taxing agency deriving revenues from the Project Area. Section 6. The Redevelopment Plan is hereby approved and adopted and is hereby designated as the official redevelopment plan of the Project Area. PASSED, APPROVED and ADOPTED this 27th day of November , 1984. Definitions. The following term: shall have the following meanings herein ■ unless the context requires otherwise. "Agency" means the Rancho Palos Verdes Redevelopment Agency. s "city" means the- City of Rancho Palos Verdes. "City Council" means the City Council of the City of Rancho Palos .Verdes. "County" means the County of Loa Angeles* "Project" means any and all undertakings of the Agency pursuant to the Redevelopment Plan or pursuant to the Law. "Project Area" means the territory included within Project Area No. 1 of the Agency■ more particularly described in Part 9 hereof. "Law" means California Health and Safety Code Sections 33000, et sea, ■ as .amended from time to time. a - "Redevelopment Plan" means this Redevelopment Plan for Project Area No. 10 "State" means the State of California ,9 EXHIBIT "A" Ordinance No. 190 Exhibit A Page 5 of 38 WLSI 32-2B PART 2, PURPOSES AND OBJECTIVES* Section 2.01. Purpases and Objectives. The Purposes and objectives of this Redevelopment Plan are to eliminate the conditions of blight existing in the Project Area and to prevent the recurrence of blighting conditions in the Project Area. The Agency proposes to eliminate such conditions and prevent their recurrence by providing, pursuant to this Redevelopment Plan, for the planning,, development, replanning, redesign and rehabili- tation of the Project Area, and by providing for such structures and spaces as may be appropriate or necessary in the interest of the general welfare. The Agency further proposes to eliminate the conditions of blight existing in the Project Area and prevent their recurrence by providing for the alteration, improvement, modernization, reconstrucom tion or rehabilitation of existing structures in the Project Area and by providing for open space types of uses, public and private buildings, structures, facilities, and improve-- ments. The Agency further proposes to eliminate such conditions and prevent their recurrence by providing for the replanning or redesign' or development of undeveloped areas. In particular, the Agency proposes to take such actions as EXHIBIT "A" Ordinance No. 190 Exhibit A Page 6 of 38 WLS13 2 -Q 3A may be necessary, desirable or .appropriate to abate the geologic hazards existing in the Project Area. EXHIBIT "A" Ordinance No. 190 Exhibit A Page 7 of 38 WLS132-04A PART 3e ALLOCATION OF TAXSS AND FINANCINGO Section 3.01. Allocation of Taxes. Taxes, if any, levied upon taxable property in the territory-described in Part 9 hereof, each year by or for the benefit of the State of California, any city, county, city-and county, district, or other public corporation (hereinafter sometimes called "taxing agencies") after the effective date of the ordinance approving this Redevelopment Plan shall be divided as follows: A. That portion of the taxes which would be produced by the rate upon which the tax is levied each year by or for each of the taxing agencies upon the total sum of the assessed value of the taxable property in the territory described in Part 9 hereof, .as shown upon the assessment roll used in connection with the taxation of such property by such taxing agency, last equalized prior to the effective date of such ordinance, shall be allocated to and when collected shall be paid to the respective taxing agencies as taxes by or for such taxing agencies on all other property are paid (for the purpose of allocating taxes levied by or for any taxing agency or agencies which did not include such territory on the effective date of such ordinance but to which such territory has been annexed or otherwise included after such effective date, the assessment roll of the county EXHIBIT "A" Ordinance No. 190 Exhibit A Page 8 of 38 WLS132-05A last equalized on the effective date of the ordinance shall be used in determining the assessed valuation of the taxable property in such territory on the effective date); and Bo That portion of the levied taxes each year in excess of such amount shall be allocated to and when collected shall be paid into a special fund of the Agency to pay the principal of and interest on loans, moneys advanced to,, or indebtedness (whether funded, refunded, assumed, or otherwise) incurred by the Agency to finance or refinance, in whole or in part, the Project, Unless and until the total assessed valuation of the taxable property in the territory described in Part 9 hereof,, exceeds the total assessed value of the taxable property therein as shown - by the last equalized assessment roll referred to in paragraph A of - this Section 3,01, all of the taxes levied and collected upon the taxable property in such territory shall be paid to the respective taxing agencies. When such loans, advances, and indebtedness, if any, and interest thereon, have been paid, all moneys thereafter received from taxes upon the taxable property in such territory shall be paid to the respective taxing agencies as taxes on all other property are paid. Section 3.02. Limitation on the Amount of Taxes Which Ka Be MMOMMOMM y_ Allocated to the Agency. The amount -of taxes which may be allocated to and received by the Agency from the Project Area for expenditure EXHIBIT "A" Ordinance No. 190 Exhibit A Page 9 of 38 WLS132-06A by the Agency in connection with the Project shall not exceed One Hundred Eighty Million Dollars ($180,000,000) expressed- in 1984 dollars and adjusted annually thereafter in accordance with changes in the Consumer Price Index for the nearest area to the Project Area, as maintained by the Bureau of.Labor statist icst United States Department of Labor. Section 3.03. Payment to Taxing Agencies. The Agency -may pay to any taxing agency which levies a'property tax in the Project Area■ an amount it deems appropriate to alleviate any financial burden or detriment caused. to any taxing agency-by the Project contemplated by this Redevelopment Plan* Section 3.04. Limitation on the Establishment of Loans I . . . . . . ..... AAvY_ftar.�©a mnA 1rr%Amh4-aAna_ac__ No loans, adVancesr or indebtedness to be repaid from the allocation of taxes described in Section 3..01 hereof, shall be established or incurred by the Agency beyond a period not to exceed forty ( 4 0 ) years from the effective date a of the ordinance of the City adopting this Redevelopment Plan. Section 3.05a Pro sed Method of Financi The Agency may issue bonds and expend the proceeds from their sale in carrying out the redevelopment of the Project-Area pursuant to this Redevelopment Plan or pur- suant to the Law or-otherwise* The Agency may finance the EXHIBIT "A" Ordinance No. 100 Exhibit A Page 10 of 38 WLS132-07A redevelopment of the Project Area by the issuance of bonds payable from taxes allocated to the Agency pursuant to Section 3.01, hereof, The Agency may borrow money or accept financial or other assistance from the State or the federal government or any other public agency. The Agency may borrow money by the issuance of bonds or otherwise or accept financial or other assistance from any private lending institution, or by any other means provided, by law,. The Agency may finance the redevelopment of the Project Area by any legally available means. The Agency shall pay principal and interest on bonds or other obligations when they become due and payable. The resolution, indenture or other document or documents providing for the issuance of such bonds or obligations shall make adequate provision for the payment of principal and interest when they become due and payable. Section 3.06. Limitation on the Amount of Bonded Indebtedness Outstand The amount of bonded indebtedness to be repaid in whole or in part from taxes allocated to the Agency pursuant to Section 3.01l above, which can be outstanding at one time,, shall not exceed sixth Million Dollars ($60■000,000) expressed in 1984 dollars and adjusted annually thereafter in accordance with changes in the Consumer Price Index for the nearest area to the Project Area, as maintained by the Bureau of Labor Statistics, United States Department of Labor, EXHIBIT. "A" Ordinance No. 190 Exhibit A Page 11 of 38 WL813 2-w 0 8 A PART 49 A QUI SITION AND DISPOSITION OF REAL PROPERTY. Section 4.01. Ac uisi.ti.on of Real Prol2ertys The Agency may acquire by gift, purchase, lease, or condemnation all or part of the real property in the Project Area: The Agency may acquire by condemnation only that real property which is necessary for the acquisition, installation or construction of projects in connection with the t abatement of geologic hazards in the Project Area or the reconstruction or relocation of Palos Verdes Drive South. The Agency shall not acquire by condemnation real property for purposes of resale for-private residential., commercial • or industrial development* Section 4.02* Commencement of Eminent Domain .Proceedi.o s . Eminent domain proceedings to acquire property in the Project Area shall be commenced within twelve (12) years from the effective date of the ordinance of the City adopting this Redevelopment Plan. Section 4.03. Dis osition of Real Proinrtye The Agency shall sell or -lease all real property acquired by it in the .Project Area except property conveyed to it by the City* Section 4.04. Nondiscrimination. All property in the Project Area is hereby subject to the restriction that there shall be no discrimination or EXHIBIT "A," Ordinance No. 190 Exhibit A Page 12 of 38 segregation based upon race, color, creed, religion, national origin, sex, marital status or ancestry ■ in the sale, lease, made expressly subject by appropriate documents to the restriction that all deeds, ,leases, or contracts for the sale, lease, sublease or other transfer of land in such territory shall contain such nondiscrimination and nonsegregagm tion clauses as may be required by law . All deeds ■ leases .or contracts for the sale, lease, sublease or other transfer of any land in such territory shall contain the nondiscrimina- t ion - clauses prescribed in the Law. Section 4e05* Dwell .n Units Removed from the Low and Moderate Income Housin Market. Whenever dwelling units housing persons and families of low or moderate income are destroyed or removed from the low and moderate income housing market as wart of a redevelopment project, the Agency shall, within four ( 4 ) -years of such removal, cause to be rehabilitated, developed, or constructed for rental or sale to persons and families of low or moderate income an. equal number of replacement dwelling units at affordable housing cost within the Project Area or within the City. Partici ati ono Each person desiring to become a participant in the redevelopment of the Project Area shall enter into an owner participation agreement with the Agency pursuant to which the participant agrees to rehabilitate ■ develop or use the real , property in conformance with this Redevelopment Plan and subject to such other provisions as may be- provided by the Agency. In such agreements# participants who retain real property shall join in the recordation of such documents as determined by the Agency. Section 5.0 . Failure to Participate as .A rasa. In the event that an owner of property in the Project Area fails to participate as agreed o the Agency may acquire such property by any legal available means ■ or may take any other appropriate action to ensure that the rede -- ve lopment of the Project Area is carried out pursuant to the provisions of this Redevelopment Plan and the Law. The Agency proposes to undertake such actions as may be n-ecessary, desirable or appropriate to abate the geologic hazards existing in the Project Area. Section 6.92. Public Pro i I - ts to be Undertaken b the k9ency. -'C. The Agency proposes to pay for all or part of the value of the land for, and the cost of, the installation or construction of the following buildings, facilities, struc- tures and improvements which will be publicly owned: A. Dewater i ng wells Be Pipelines C. Storm drains Do Breakwaters E. Jetties F. Culverts, pipes and channels Go Revetments He Relocaiton or reconstruction of Palos Verdes Drive South and other public streets serving the Project Area I. Installation or relocation of utilities EXHIBIT "V! Ordinance No. 190 Exhibit A Page 15 of 38 WLS 13 2--12A PART 7* SAFEGUARDSE RETENTION OF CONTROLS AND PARTICIPATION By THE C1'l'y. Section 7.01. Sa eguards. To provide adequate safeguards to ensure that the provi a i on..s of this Re-development Plan will be carried out and to prevent the recurrence of the conditions of blight in the Project Area, all real property sold, leased, or ' c+ no- vey d by the Agency, as well as property subject to owner participation a reem ntsl shall be made subject to the provisions of the Plan by leases, deeds ■ contracts, agFr e"M tents ■ declarations or restrictions, and such real property shall be subject to provisions of the zoning ordinance of the City, conditional use permits, and ether Pedcral, state and local. laws ■ rules and ragul at.iona, all as the sane may be amended from time to time. Where appropriate, as deter-M mi-ned by the Agency ■ such documents or portions thereof shall be recorded in the office of the-County ]recorder. Section 7.02. Retent ion of Controls. The Agency or City Council., may impose further restrictions and controls on the land leased or sold by the Agency for such periods of time and under such conditions as deemed necessary to effectuate the purposes of the Law. Section 7.04. Expenditure of Monedy by the Cit . The City may expend all funds which may be necessary or appropriate in connection with the redevelopment of the Project Area. Section 7.05. Proceedin s Undertaken by the City, The City may undertake and complete any proceedings necessary to carry out the redevelopment of the Project Area. Open Since* The approximate amount of open space to be provided in the Project Area includes, without limitation, all areas which will be in the public rights of way ■ .parks and recreational areas, open spaces around buildings and other outdoor areas not o'overed by buildings or .structures. Section 8.02. Street Layout* The street layout in the Project Area may be generally described as follows: A major arterial running east and west through the entire Project Area. The ream mainder of streets are local servicing residences only. The street layout in the Project Area may be altered to accommo -- date the redevelopment of the Project Area. Section. 8.03. Build ng . The limitation on the type, size, height, number and proposed use of buildings in the. Project Area shall be determined by the zoning ordinance of the City and other applicable Federal, state and local laws, rules and regula- tions, all as the same may be amended from time to time. The number of dwelling units in the Project Area may in- crease as a result of the redevelopment of the Project Area. section 805. Public Pr ert . The property to he devoted to public purposes in the Project Area includes all public streets and rights- of -way which may be used for vehioul. ar l pedestrian or equestrian traff io ■ and all other public improvement ■ and public and private utilities typically found in public rights -o-of way.
