AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES
ESTABLISHING A PROCEDURE FOR IMPOUNDING DANGEROUS
ANIMALS AND AMENDING THE RANCHO PALOS VERDES
MUNICIPAL CODE
THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES does ordain as follows:
Section 1. Chapter 6.08 of the Rancho Palos Verdes Municipal
II Code is hereby amended by adding the following subsection to read:
6.08.150 Dangerous Animal. Whenever any dog is, in the opinion of
the Director, vicious, dangerous or apt to bite or injure any person, and is
kept in such a manner as to constitute an apparent menace or threat to any
person in a public place or lawfully in a private place other than the property
of the owner of the dog, the dog may be immediately impounded by the Director.
As soon as reasonably possible after the dog is so impounded, the owner of
the dog, or the person harboring. the dog, or the person to whom the license for
the dog was issued, if any, or any person whose name appears thereon, shall be
notified, either personally or by registered mail addressed to the person, at
the address shown on the license or alleged to be the residence of the dog, of
the fact of the impounding and that the person or persons interested may appear
at a hearing before the City Manager to be specified in the notice. The notice
of the hearing shall be served at least forty-eight hours prior to the time of
the hearing. The Director shall have the burden of showing to the satisfaction
of the City Manager that the dog is vicious, dangerous or apt to bite or injure
any person, and is kept in such a manner as to constitute a menace or threat to
any person in a public place or lawfully in a private place other than the
of the owner of the dog. The City Manager shall hear all persons who j
property
appear and desire to be heard. If the City Manager finds that the Director has i
made the showing required above, he may order the dog destroyed or otherwise
disposed of. He may also release the dog on the condition that the owner will
take measures specifed by the City Manager to control the dog so as not to
constitute a menace or threat to any person in a public place or lawfully in a
private place other than the property of the owner of the dog. If the City
Manager finds that the Director has failed to make the required showing, the
City Manager shall order the dog to be released. The decision of the City
Manager may be appealed in writing to the City Council within five days of the
City Manager°s decision. The decision of the City Council shall be final and
conclusive.
