AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES
ESTABLISHING ZONING AND PROHIBITING DEVELOPMENT
FOR THE "EASTVIEW" VEXATION AREA AND DECLARING
THE URGENCY THEREOF.
THE CITY COUNCIL OF THE. CITY OF RANCHO PALOS VERDES DOES ORDAIN AS FOLLOWS:
Section 1. All property located within the "Eastview" annexation
area outlined in red on Exhibit "A" of this Ordinance, which property became
annexed to the City of Rancho Palos Verdes on January 5, 1983, is hereby
zoned RS--4, and no applications for a building permit, variance, or other
authorization for construction, grading, or development not in conformity
with said zoning classification shall be accepted, processed or issued by
the City except as specified .in Section 3 hereof. A map of said "Eastview"
area is attached hereto as Exhibit"A".
Section 2. No application for a conditional use permit, subdivision
map, parcel map, or zone. change for property located in the "Eastview" area
shall be accepted, processed or issued by the City.
Section 3. Properties in the "Eastview"area which were included
in the commercial zoned district by the County of Los Angeles on the effective
date of the annexation and which were developed with uses conforming to said
classification- may be changed to a commercial use listed as an automatically
permitted use under the County of Los Angeles zoning classification applicable
to said property on the effective date of the annexation. No change may be
made to a commercial use listed as requiring a conditional use permit under
the applicable County of Los Angeles zoning classification.
Section 4. The City of Rancho Palos Verdes has recently annexed
the "Eastview" area. The City is currently conducting studies to determine
appropriate zoning for this area, Until such time as these determinations
are made and properties placed in the appropriate zone, a moratorium to
prohibit development which might be contrary to said permanent regulations
is necessary. If this moratorium is not enacted, the property could.be
developed with uses which could cause an immediate threat to the public
health, safety and welfare. This ordinance places the entire area into the
most restrictive classification which is likely to be established for any
part of the area. This. Ordinance will prohibit development contrary to the
permanent regulations, is necessary for the health, safety and general
welfare, shall take effect immediately upon its adoption, and shall be of no
further force and effect forty-five days following the effective date hereof
unless extended by the City Council pursuant to Section 65858 of the
California Government Code.
