AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES
AMENDING ORDINANCE NO. 108U, AS AMENDED BY
ORDINANCES NO. 118U, 120U, 123U, 130U, 131U,
139U, 140U, 143U, 148U AND DECLARING THE URGENCY
THEREOF
The City Council of the City of Rancho Palos Verdes does hereby
ordain as follows:
Section 1: Section 5, d of Ordinance No. 108U, as amended, is re-
vised to read as follows:
Section 5.
(d) Replace is to exchange a damaged portion for a new equivalent
portion without changing form or function. For a dwelling it is to con-
struct a new or new major portion of a dwelling to substitute for that
existing prior to damage.
Section 2: Section 6 of Ordinance No. 108U, as amended, is revised
to read as follows:
Section 6. Residential single-family structures replacement
shall be governed by the following:
(a) Replacement is allowed for structures destroyed after June
26, 1975 and which have not been abandoned.
(b) Abandonment shall be declared when no continuing occupancy of
a dwelling damaged so as not to be habitable (pursuant to the minimum re-
quirements of the Building Code) occurs for a period of one year and no
applications for replacement are made within that year. Any hazards
existing or continuing as a result of abandonment" must be abated within
thirty (30) days of the declaration of same.
(c) Replacement shall be limited to the same square footage and
in the same general location on the property.
(d) Setbacks may be waived upon application to the Director of
Planning.
(e) If more than ninety percent of the value of the structure is
destroyed by earth movement, the structure may not be replaced. Percen-
tage of the destruction shall be determined by the Director of Planning.
Value is defined as the estimated cost to replace the building in kind,
based on current replacement costs for all construction and appurtenances.
Section 3: Section 8 is added to Ordinance No. 108U, as amended, to
read as follows:
Section 8. The Building Code, as amended, and existing plan
checking procedures are adequate and appropriate to allow maintenance,
repair, restoration, replacement, and alteration as defined. Section 308
of the Code applies and permits are required. A non-suit covenant must
be filed with the City relieving the City of responsibility related to
whatever hazard may exist.
Section 4: In order to protect the public health, safety, and welfare
it was necessary for the City of Rancho Palos Verdes to adopt an urgency
ordinance establishing a moratorium on certain permits in that area of the
City identified as the "Landslide Moratorium" area. Preliminary geology
studies have now been completed and it is appropriate to make certain
modifications and clarifications to the ordinance. This ordinance effect-
ing said clarifications is necessary for the public peace, health, safety,
and welfare and shall take effect immediately upon adoption as an urgency
ordinance because it will assist the property owners in knowing what steps
are applicable to damaged structures.
