ORD 143U ORDINANCE NO. 143U
AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES
AMENDING ORDINANCE NO. 108U, AS AMENDED BY
ORDINANCES NO. 118U, 120U, 123U, 128U, 130U,
131U, 139U AND 140U, AND DECLARING THE URGENCY THEREOF
The City Council of the City of Rancho Palos Verdes does hereby ordain
as follows:
Section 1: Section 4 of Ordinance No. 108U as amended by Ordinances
No. 118U, 120U, 123U, 128U, 130U, 131U, 139U and 140U is amended to include
the following:
(k) Processing and approval of tentative and ,-
final parcel maps and related documents for property
within the moratorium area that contains residential
structures that are already completed and occupied and
for which a condition of processing of the maps will
be the filing of an agreement with the City that no
additional structures shall be built within the area
covered by the map and that no grading shall take
place therein except in accordance with the ordinances
pertaining to the moratorium imposed on the subject
property. Said maps shall specifically reference the
moratoriums in force by the City and shall prohibit
additional construction and grading on the property
covered by any map processed hereunder except in
accordance with the moratorium ordinances until such
time as the moratorium is lifted or amended.
Nothing contained in this section shall exempt
or except the proposed construction or use from any
requirement or regulation of the Building Code,
Zoning Ordinance or other ordinance of the Rancho
Palos Verdes Municipal Code. Conditions may be
attached to such permits, such as non-suit covenants
and sewer assessment agreements.
All applicants for permits or approvals under
this ordinance as amended shall submit to the City
a hold harmless agreement satisfactory to the City
Attorney promising to defend, indemnify, and hold
the City harmless from any claims or damages re-
sulting from the requested activity.
Section 2: In order to protect the public health, safety and welfare
it was necessary for the City of Rancho Palos Verdes to adopt an urgency ordinance
establishing a moratorium on certain permits in that area of the City identified
as the "Landslide Moratorium" area. Preliminary geology studies have now been
completed and it is appropriate to make certain modifications to the ordinance.
This ordinance effecting said modifications is necessary for the public peace,
health, safety and welfare and shall take effect immediately upon adoption as
an urgency ordinance.
