ORD 125 ORDINANCE NO. 125,, AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES APPROVING CODE AMEND- MENT NO. 8 AND AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE WHEREAS, the City has initiated Code Amendment No. 8; and WHEREAS, the City Council has held a public hearing on this matter on December 18, 1979, at which time all interested parties were given an oppor- tunity to be heard and present evidence; and WHEREAS, the Planning Commission has held a public hearing on this matter on November 27, 1979, and has recommended approval in Resolution No. 79-22 P.C. ; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY ORDAIN AS FOLLOWS: Section 1: The City Council has reviewed and considered the Environ- mental Assessment No. 381 Initial Study and final Negative Declaration and finds that the approval of this Code Amendment will not result in significant adverse environmental impact to the area. Section 2: The City Council finds that the Code Amendment is con- sistent with the General Plan. Section 3: The Rancho Palos Verdes Municipal Code, Article IX, Chapter 4, Part One is hereby amended by amending subsection 9412, F to read: 9412, F. Within areas currently experiencing downslope movement, only residential single family buildings and structures existing on June 26, 1975 may be used; or restored providing: 1. The owner files a non-suit covenant with the City of Rancho Palos Verdes relieving said City of responsibility related to whatever hazard may exist. 2. Said restoration will not aggravate the present condition. 3. Homes must be occupied or the owners must make application for restoration or replacement within one year of damage. 4. Restoration or replacement shall be limited to the same square footage and in the same general location on the property. 5. Setbacks may be waived for restoration upon application to the Director of Planning. 6. If more than ninety-0-0) percent of the value'of the structures'is destroyed= by earth .movement, the structure may not-be replaced or repaired. Percentage of the destruction shall be determined by the Director of Planning. Value is defined as the estimated cost to replace the building in kind, based on current replacement costs for all construction and appurtenances.
