AN ORDINANCE OF THE CITY OF RANCHO PALOS
VERDES AMENDING ORDINANCE NO. 108 U, AS
AMENDED BY ORDINANCE gip:, 118 U, AMENDING
THE RANCHO PALOS- VERDES MUNICIPAL CODE AND
DECLARING THE URGENCY THEREOF
THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY ORDAIN AS
FOLLOWS:
II/ Section 1. Section 4 of Ordinance No. 108 U, as amended by Ordi-
nance No. 118 U, is amended to read as follows:
Section 4. The moratorium or limitation provided for in Sec-
tions 2 and 3 hereof shall not be applicable to any of the following:
(a) Repairs or renovation of existing structures or
facilities which do not increase the land coverage of those facilities or
add to the water usage of those facilities.
(b) Reconstruction on the same foundation of a building
or structure which has been damaged or destroyed by fire, providing said
restoration will not aggravate the present condition.
(c) Permits for existing structures for which permits
were not previously granted.
(d) City Council directed Environmental Assessment or
Environmental Impact Report.
(e) Any City Council approved project to mitigate the
potential for landslide.
(f) Remedial grading to correct problems caused by
landslide.
(g) The City Council may also approve exemption of minor
projects (projects not involving new buildings) providing a geology study
is approved by the City geologist indicating that the project will not
aggravate the existing situation.
(h) Resubmittal of a parcel map which has previously
been approved by the Planning Commission.
Nothing contained in this section shall exempt or except the
proposed construction or use from any requirement or regulation of the
Building Code, Zoning Ordinance or other ordinance of the Rancho Palos
Verdes Municipal Code. Conditions may be attached to such permits, such
as non-suit covenants and sewer assessment agreements.
Section 2. In order to protect the public health, safety and wel-
fare it was necessary for the City of Rancho Palos Verdes to adopt an urgency
ordinance establishing a moratorium on certain permits in that area of the
City identified as the "Landslide Moratorium" area. Preliminary geology
studies have now been completed and it is appropriate to make certain modi-
fications to the ordinance. This ordinance effecting said modifications is
necessary for the public peace, health, safety and welfare and shall take
effect immediately upon adoption as an urgency ordinance.
PASSED, APPROVED AND ADOPTED this 4th day of September, 1979 on the
following roll call vote:
