ORD 081U ORDINANCE NO, 81U AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES ESTABLISHING A CURFEW FOR MINORS AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE AND DECLARING THE URGENCY THEREOF. THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY ORDAIN AS FOLLOWS: Section 1 : Article IV of the Rancho Palos Verdes Municipal Code is hereby amended by adding Chapter 3 thereto to read as follows : "CHAPTER 3 - CURFEW REGULATIONS 4300. General Restrictions Against Loitering By Minors. It is unlawful for any minor under the age of eighteen years to loiter, idle, wander or stroll aimlessly in or upon the public streets , highways, roads, alleys , parking lots, parks, playgrounds, shopping centers , or other public grounds, public places and public buildings, vacant lots or any unsu- pervised place between the hours of ten p.m. and daylight immediately following, unless accompanied by his or her parent or legal guardian having legal custody and control of such person, or by the spouse over =$eighteen (18.:) years of age of such person. 4301. Loitering in Public Places When They Are Closed. Between the hours of nightfall and daylight immediately following, it is unlawful for any minor under the :age of eighteen years to loiter, idle, wander, or stroll aimlessly- in public places such as shopping centers, public buildings, public grounds, parking lots, parks and playgrounds which are at the time, not open for business or recreation. 4302 . Duty of Parents and Guardians. It is unlawful for any parent, guardian, or other person having the legal care, custody, or control of any minor under the age of eighteen years to knowingly aid, abet, or encourage such minor person to violate any provision of this chapter. 4303 . Violations of Curfew Regulations, Penalty. Any person violating any of the provisions or failing to comply with any of the requirements of this chapter shall be guilty of a misdemeanor. Any person convicted of a misdemeanor under the provisions of this chapter shall be punishable by a fine of not more than Five Hundred Dollars, or by imprisonment in the County Jail for a period not exceeding six months , or by both such fine and imprisonment. Section 2 : Large numbers of young people are gathering in the evenings in various parking lots and shopping centers in Rancho Palos Verdes without lawful purpose. Such gath- erings are detrimental to the public peace, health, safety, and welfare of the people of the city as they are resulting in increased juvenile crime and fear of crime or injury on the part of those persons who want to use public places for lawful purposes. With the coming of the winter holidays, children will be free from school and thus, such loitering and the detrimental effects it causes will be increased. Ordinance Number 81 providing for curfew regulations prohibiting such loitering will not be effective until February 5, 1976. Therefore, this emergency Ordinance is necessary for the immediate preservation of the public peace, health, safety and general welfare, and shall be effective immediately upon adoption.
