ORDINANCE NO. 54
AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDE S
EXTENDING THE MORATORIUM ON CERTAIN PERMITS AND
THE PROCESSING OR APPROVAL OF TENTATIVE MAPS,
FINAL MAPS OR PARCEL MAPS IN CERTAIN AREAS AND
DECLARING ISSUANCE OF BUILDING AND GRADING
PERMITS IN THE REMAINDER OF THE CITY SUBJECT
TO ENVIRONMENTAL IMPACT REPORT PROCEDURES
THE CITY COUNCIL OF THE CITY OF RANCHO PALO S VERDE S DOES HEREBY
ORDAIN AS FOLLOWS:
Section 1. The City of Rancho Palos Verdes heretofore
adopted Ordinances 16, 16U and 29U, declaring a moratorium on
the issuance of building, grading or other permits and on the
processing or approval of tentative maps, final maps or parcel
maps in certain areas of the City, and providing for the issuance
of building and grading permits in the remainder of the City only
upon a finding that such construction or grading would not have a
significant effect on the environment, said ordinances to expire
eight months after adoption thereof. An extension of said morato-
rium and limitation is necessary pending completion of general
plan and zoning studies currently in process.
Section 2. Notwithstanding any other Ordinance or
Code of the City of Rancho Palos Verdes and except as provided
in Section 3 hereof, no building permit, grading permit or other
permit for new construction shall be issued and no tentative map,
final map or parcel map for the subdivision of land shall be
accepted for filing, processed or approved as to any property
located in that portion of the City of Rancho Palos Verdes out-
lined in red upon that certain map known and designated as the
"Moratorium Map" on file in the office of the Director of Planning
of said City and incorporated herein by reference.
Section 3. The moratorium or limitation provi,ded for
in Section 2 hereof on the issuance of building, grading or other
permits shall not be applicable to any of the following:
a) Repairs or renovation of existing structures
or facilities; i
b) Reconstruction of an existing buildin or ?
structure where a portion, not to exceed 25 /0,
thereof has been damaged or destroyed by fire
or other casualty;
c) Additions to existing buildings or structures
which do not exceed 25% of the area of the
existing building or structure and which do
not add an additional story to or increase
the height of the existing building or
structure;
d) Accessory buildings not exceeding 400 square
feet in size or more than 12 feet in height;
e) Swimming pools.
Nothing contained in this section shall exempt or except the
proposed construction or use from any requirement or regulation
of the Building Code, Zoning or other ordinance or of the
Rancho Palos Verdes Municipal Code, nor from the provisions
of Section 4 of this Ordinance.
Section 4. Notwithstanding any other Ordinance or
Code of the City of Rancho Palos Verdes, no building permit or
grading permit shall be issued unless a finding can be and is
made that the construction or grading will not have a significant
effect on the environment. The Director of Planning shall be
in charge of the administration of the procedures necessary for
the preparation and consideration of environmental assessments
or environmental impact reports necessitated by this section.
Appeals from determinations regarding the need for or sufficiency
of environmental impact reports made by either the Director of
Planning or other agent or agency designated by the City Council
shall be heard and determined by the City Council. The Director
of Planning may recommend and the City Council may adopt by
resolution procedures, criteria and standards of evaluation to
be utilized. in the administration of this section.
Section 5 . Ordinance No. 54U is hereby superseded and
repealed upon the effective date hereof.
