ORD 017U ORDINANCE NO. 17U
AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES
PROVIDING FOR CERTIFICATES OF OCCUPANCY, AND
AMENDING THE BUILDING CODE AND THE RANCHO PALOS
VERDES MUNICIPAL CODE, AND DECLARING THE URGENCY
THEREOF
THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY
ORDAIN AS FOLLOWS:
Section 1. The Building Code and the Rancho Palos
Verdes Municipal Code are hereby amended by adding Section 8101
to the Rancho Palos Verdes Code to read:
"Section 8101. Notwithstanding the provisions of
Section 8100 the Building Code is hereby amended by
amending subsections (a) and (c) of Section 306 to
read:
' SEC. 306 -- CERTIFICATE OF OCCUPANCY
(a) Iseor_9=2alici. No building or struc-
ture
ture in Groups A to J, inclusive, shall be used
or occupied, and no change in the existing occu-
pancy classification of a building or structure
or portion thereof shall be made, until the Build-
ing Official has approved the building or struc-
ture for such use or occupancy and has issued a
certificate of occupancy therefor.
A building of Group H or I occupancies if
erected on a site where grading has been performed
pursuant to a grading permit issued under provi-
sions of this code shall not be occupied, nor shall
gas or electric utilities be connected thereto,
unless the grading has been completed in accordance
with all applicable requirements of Chapter 70 or
the Building Official has found, should the grading
not be so completed, that the site conditions will
pose no hazard to the health, safety, or welfare of
occupants and/or occupants of adjacent properties .
(c) Certificate Issued. After final inspec-
tion when it is found that the building or struc-
ture complies with the provisions of this Code and
all other applicable provisions of the Rancho Palos
Verdes Municipal Code, and the environmental excise
tax provided for by Article VI, Chapter 7 of the
Rancho Palos Verdes Municipal Code has been paid,
the Building Official shall issue a Certificate of
Occupancy which shall contain the following:
1. The building permit number.
2. The address of the building.
3. The name and address of the owner.
4. A description of that portion of the
building for which the certificate is issued.
5. A statement that the described por-
tion of the building complies with the require-
ments of this Code for group of occupancy in which
the proposed occupancy is classified.
6 . The name of the Building Official. ' "
Section 2. The City of Rancho Palos Verdes has
recently become incorporated on September 7 , 1973. Numerous
dwelling units and other buildings are presently under con-
struction or construction thereof is imminent. The immediate
establishment of requirements for Certificates of Occupancy
for all such buildings presently under construction is essential
to the preservation of the public peace , health, safety and
welfare by reason of the above facts and the fact that the
occupancy of additional buildings without provision for allevi-
ation of the environmental impact therefrom will adversely affect
the quality of life, environment and ecology within the City,
increase the pollution of air and water and overburden the public
facilities of the City. The City has not yet been able to com-
plete a general plan and accordingly at present is unable to
utilize the provisions of the Quimby Act. This Ordinance is
essential for the effectiveness of Ordinance 14, and Ordinance 14U,
this day adopted. This ordinance is therefore an urgency ordinance
necessary for the immediate preservation of the public peace,
health, safety and welfare and shall take effect immediately.
