The Mayor of the City of Rancho Palos Verdes Is authorized to execute a contract with tie Coun y of Los Angles for and in behalf of the City of Rancho Palos Verdes providing for animal control services. .r /.rte M./or • ATTEST: Clerk e • I HEREBY CERTIFY that the foregoing is a true and correct copy of a Resolution passed and adopted by the City Council of the City of RANCHO PALOS VERDES at a regular meeting thereof held on th e 7th aay of ptember 1973 . • City Clerk 9/73 • s � • AGREEMENT ANIMAL CONTROL SERVICES THIS AGREEMENT, made and entered into this 7th , day of September 19- 73, by and between the COUNTY OF LOS ANGELES, hereinafter sometimes referred to as "County, " and the CITY OF RANCHO PALOS VERDE hereinafter sometimes referred to as "City, " WITNESSETH: THAT WHEREAS, the City is desirous of contracting with the County for the performance of the hereinafter described Animal Control services within its boundaries by the County of Los Angeles through the Director of Animal Control thereof; and WHEREAS, the County of Los Angeles is agreeable to rendering such services on the terms and conditions hereinafter set forth; and WHEREAS, such contracts are authorized and provided for by the provisions of Section 56i of the Charter of the County of Los Angeles and Article 1, Chapter 1, Part 2, Division 1, Title 5 of the Government Code; NOW, THEREFORE, IT IS AGREED as follows: 1 . The County agrees, through the Director of Animal Con- trol of the County of Los Angeles, to provide animal control services within the corporate limits of City to the extent and and in the manner hereinafter set forth. Such services shall only encompass duties and functions of the type coming within the jurisdiction of and customarily g rendered by the Department of Animal Control of the County of Los Angeles under the charter of said County and the statutes of the State. The level of service shall be that same basic level of ser- vice that is and shall be hereafter during the term of this agreement provided for unincorporated areas of the County of Los Angeles by said Director of Animal Control . The rendition of such services, the standard of performance and other matters incidental to the performance of such services, and the control of personnel so employed, shall remain in the County. In event of dispute between the parties as to the extent • of the duties and functions to be rendered hereunder, or the level and manner of performance of such service, the determination thereof made by the Director of Animal Control of the County shall be final and conclusive as between the parties hereto. Such service shall include the enforcement of State statutes and such municipal animal control ordinance as the City may adopt, as hereinafter provided for. 2. To facilitate the performance of said functions, it is hereby agreed that the County shall have full cooperation and , assistance from the City, its officers, agents and employees. 3. For the purpose of performing said functions, County shall furnish and supply all necessary labor, supervision, equip- ment and supplies necessary to maintain the level of service to be rendered hereunder. Notwithstanding anything hereinbefore contained, it is agreed that in all instances wherein special supplies, stationery, notices, forms and the like must be issued in the name of said City, the same shall be supplied by said City at its own cost and expense. -2- 0 • 4 . All persons employed in the performance of such services and functions for said City shall be County employees and no City employee as such shall be taken over by said County, and no person employed hereunder shall have any City pension, civil service, or any status or right . For the purpose of performing such services and functions, and for the purpose of giving official status to the performance thereof where necessary, every County officer and employee engaged performance the erformance of any service hereunder shall be deemed to be an officer or employee of said City while performing services for said City, which services are within the scope of this agreement and are purely municipal functions . City 5. Cit shall not be called upon to assume any liability for the direct payment of any salaries, wages, or other compen- sation to any County personnel performing services hereunder for said County, or any liability other than that provided for in this agreement. Except as herein otherwise specified, the City shall not be liable for compensation or indemnity to any County employee for injury or sickness arising out of his employment. 6. County, its officers and employees, shall not be deemed to assume any liability for intentional or negligent acts of said City or of any officer or employee thereof. 7. Unless sooner terminated as provided for herein, this agreement shall be effective immediately and shall terminate on June 30 , 1978 . At the option of the City Council of said City, with the consent of the Board of Supervisors of said County, this agreement shall be renewable for successive -3_ periods of not exceeding five (5) years each. In event City desires to renew this agreement for any succeeding five-year period, the City Council, not later than December 31 next preceding the expiration date of this agreement, shall notify the Board of Supervisors of County that it wishes to renew the same, whereupon said Board of Supervisors, not later than the last day of January, shall notify said City Council in writing of its willingness to accept such renewal for an additional five-year period or such other term as it deems advisable, otherwise such agreement shall finally terminate at the end of such five--year period. Notwithstanding the provisions of this paragraph hereinbefore set forth, either party may terminate this agreement as of the first day of July of any year upon notice in writing to the other party of not less than two calendar months prior to the date of such termination. 8. Notwithstanding anything to the contrary herein contained, this contract shall be sooner terminated at any time that City fails to enact and to maintain in full force and effect, including the amount of fees provided, an ordinance identical with the pro- visions • . visions of the County Animal Control Ordinance, Los Angeles County Ordinance No. 4729. This contract shall also be sooner terminated if City does not enact amendments to said ordinance adopted by the Board of Supervisors within 120 days after request to do so by County. The County Director of Animal Control, acting on behalf of the County, may use discretion and need not request City to adopt amendments which do not apply to the City. -4- 9. For and in consideration of the rendition of the fore- going services by the County, .City agrees that County may keep and retain any and all licenses and fees provided for by said Municipal Animal Control Ordinance and collected by the County pursuant hereto. It is agreed that in connection therewith the County shall have all powers of the City and shall receive all cooperation possible therefrom to enable efficient enforcement of such municipal ordinance and to effectuate collections called for thereunder. 10. The County shall retain all impounding fees and revenue • derived from the sale of dogs at the County shelter as additional compensation for expenses incurred for care and feeding of said animals and emergency night calls. 11. The County agrees to maintain its kennels and animal shelter in a humane manner and keep said premises in a sanitary condition at all times, and that all services furnished by it hereunder shall be in accordance with the laws of the State of Calirornia, and that, it will give the prescribed notices and use humane methods of care and destruction of any animal coming under its jurisdiction. 12. The County agrees to keep such books and records and in such form and manner as the County Auditor-Controller of the County of Los Angeles shall specify. Said books shall be open for examination by said City at all reasonable times.
