CC MINS 19920407M I N U T E S RANCHO PALOS VERDES CITY COUNCIL REGULAR MEETING APRIL 7, 1992 The meeting was called to order at 6:00 PM by Mayor MoTaggart at the Hesse Park Community Center, 29301 Hawthorne Boulevard, for a work session to discuss the Management Services Institute (MSI) City Fee Study, MSI President Rick Kermer provided an in-depth overview of the City Fee Study. He responded to Council inquiries pertaining to the Fee Study, including overhead charges and the idea of an assessment district. Council discussed the idea of staff providing an executive sum- mary of the staff recommendations for City fees. Council agreed to additional worksessions prior to staff making a recommenda- tion. The next worksession date of May 4, 1992 was agreed to. The regular meeting was called to order at 7:10 PM by Mayor McTaggart. City Council 4/07/92 APPROVAL OF AGENDA The agenda was modified as follows: South Bay Bus Coordination Effort and the Minutes of February 18 and March 3, 1992 were moved to Regular Business and RTD Line 225 and LACTC Voting Up- date were added to Regular Business* Councilwoman Bacharach moved, seconded by Councilwoman Brooks, to approve the amended agenda as presented. The motion carried unanimously* At this time, Councilwoman Bacharach noted a communication requesting postponement of the Revision of the Conditions of Ap- proval for Vacation of Searaven Drive from Heroic Drive to the cul-de-sac. PALOS VERDES HIGH SCHOOL - PROPOSED HOME TOURS (1401) Received and ordered filed the information regarding the Home Tours Program proposed by the Palos Verdes High School PTSA, RESOLUTION NO, 92-29--1 ORDERING THE CANVASS OF THE SPECIAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, APRIL 1:4, 1992 BE MADE BY THE CITY CLERK (501) Adopted RESOLUTION NO. 92-2%,,-ORDERING THE CANVASS BE MADE, REGISTER OF DEMANDS - Adopted RESOLUTION NO. 92-30 The motion to approve the Consent Calendar carried on the folloi,,j- ing roll call vote: AYES: BROOKS, KUYKENDALL, BACHARACH, RYAN AND MAYOR MC TAGGART, NOES: NONE* City Council 4/07/92 3 HOUSEHOLD HAZARDOUS WASTE ELEMENT (1301) Acting Director of Environmental Services Petru presented the staff report with the recommendation that Council adopt the Final Mitigative Negative Declaration for Environmental Assessment No. 632 and adopt the Household Hazardous Waste Element. MOTION: Councilwoman Brooks moved to approve the Final Mitiga- tive Negative Declaration for Environmental Assessment No. 632 and the Household Hazardous Waste Element as recommended by staff. The motion was seconded by Councilwoman Bacharach and, there being no objection, it was so ordered by Mayor McTaggart. MOTION: Councilwoman Brooks moved to adopt- Resolution No. 92-32 adopting a Household Hazardous Waste Element and Resolution No. 92-31 adopting the Mitigated Negative Declaration for Environmen- tal Assessment No. 632 for a Household Hazardous Waste Element of the General Plan. The motion was seconded by Councilwoman Bacharach and, there being no objection, it was so ordered by Mayor McTaggart. REVISION OF THE CONDITIONS OF APPROVAL FOR VACATION OF SEARAVEN DRIVE FROM HEROIC DRIVE TO THE CUL-DE-SAC (1408) Council discussed whether consideration of the revision of the Conditions of Approval for vacation of Searaven Drive from Heroic Drive to the cul-de-sac should be continued (a communication to this effect noted earlier in the meeting by Councilwoman Bacharach). Council discussed the importance of giving inter- ested parties an opportunity to voice their opinions on this mat- ter. Mayor McTaggart opened the public hearing* Ms. Kathy Johnstone, 3517 Palo Vista Drive, residing adjacent to the subject property, stated her concern that a pathway would provide access to her back yard and that an easterly facing park bench would impact her privacy. She asked that she be notified of recommended conditions prior to subsequent meetings on this subject* Council asked that residents, as well as the Seacliiff and Ladera Linda Homeowner Associations, be properly noticed of any sub- sequent hearings* I Assistant Public Works Director Kevin Smith provided clarifica- tion with regard to the public noticing of the item. City Council 4/07/92 4 Deputy City Manager Rohloff indicated that those speaking to this item at previous public hearings will be noticed if the item is continued. Mr. Bill James, 3517 Palo Vista Drive, voiced his concern that City money is being spent on projects such as this. He related his objection to a trail link on the subject property* Sunshine, 6 Limetree Lane, explained her understanding that the staff report contains no information about changes to be con- sidered'. She pointed out that the approved easement is not the one recommended by.the Trails' Committee. MOTION.* Councilwoman Bacharach moved, seconded by Councilwoman Brooks, to continue the the public hearing on the Revision of the Conditions of Approval for -the Vacation of Searaven Drive from Heroic Drive to the Cul-De-Sac. It was so ordered by Mayor McTaggart with Councilman Ryan dissenting. At this time, there was a Drawing for Recycling... DRAWING FOR RECYCLING Resident names were drawn for one free year of trash pick up. At this -time, discussion continued in regular agenda order... STATUS OF RTD LINE 225 (1505) Councilwoman Bacharach and Deputy City Manager Rohloff reported on the anticipated reinstatement of old RTD Line 225, tentatively scheduled for April 20, 1992. RTD's recommendation for a run- away lane on Crenshaw Boulevard was noted. MOTION,: Councilwoman Bacharach moved that the City Manager be asked to get Rancho Palos Verdes on the soonest RTD agenda and that the City be given written confirmation that RTD Line 225 has been reinstated. The motion was seconded by Councilwoman Brooks and carried. City Council 4/07/92 5 SOUTH BAY BUS COORDINATION EFFORT (1505) Council discussed whether the City is in a position to finan- cially participate in a study leading to the identification of needed bus services and possible ways to meet those unmet needs in the South Bay, pending a final analysis of the number of cities agreeing to participate. It was agreed that Council would support the study and that the item will be returned for con- sideration on April 21, 1992. MOTION: Councilwoman Brooks moved, seconded by Councilman Kuykendall, that the City support a study leading to the iden- tification of needed -bus services and possible ways to meet those unmet needs in the South Bay, pending a final analysis of the number of cities agreeing to participate, and that the item be returned for consideration on April 21, 1992. There being no ob- jection, it was so ordered by Mayor McTaggart. MINUTES OF FEBRUARY 18 AND MARCH 3, 1992 (301) Council discussed whether Paragraph 9, Page 5 of the February 18, 1992 minutes should be modified to include wording that the plaque is to list all of the City Council members and whether Paragraph 10, Page 5 should be modified to include that the plaque is to list only "Rancho Palos Verdes City Council." MOTION.* Councilman Ryan moved, seconded by Councilwoman Brooks, that Page 5 of the February 18, 1992 minutes remain as originally prepared. The motion was passed by a 3-2 oral vote with Council- woman Bacharach and Councilman Kuykendall dissenting. MOTION.* Councilwoman Brooks moved, seconded by Councilman Ryan, to approve the February 18 and March 3, 1992 minutes as amended. It was so ordered by Mayor MeTaggart with Councilwoman Baoharach dissenting. UPDATE REPORT ON "NO-LOW" PROPERTY TAX REVENUES Deputy City Manager Rohloff supplied updated information on "No- Low" property tax revenues. He explained that "No-Low" property tax legislation, will increase the amount of property tax monies the City of Rancho Palos Verdes will receive this year. Council thanked Supervisor Dana for his assistance in facilitating this legislation. I City Council 4/07/92 0 UPDATE REPORT ON AB939 - SOLID WASTE (1301) Director of Public Works Reed provided updated information on AB939, a Statewide effort to reduce the amount of solid waste to be disposed of by landfill or incineration. Deputy City Manager Rohloff offered that staff will keep Council informed of progress in this area* Ms. Lois Laruel 3136 Barkentine Road, stated her understanding that, contrary to information contained in the City's Source Reduction and Recycling Element (SRRE), the City is not diverting approximately forty percent of its waste. Director Reed indi cated that staff ^^ will provide background information on figures contained in the SRRES CABLE TV JOINT POWERS AUTHORITY (605) Assistant to the City Manager Antil provided the staff report, with the Cable Subcommittee recommendation that Council authorize. the Mayor to transmit to the City of Rolling Hills Es- tates the City's formal notice to withdraw from the Palos Verdes Peninsula Cable Television Joint Powers Authority and the crea- tion of a separate, informal Peninsula Public Access Cable Television Committee by extending invitations to the cities of Rolling Hills, Palos Verdes Estates and Los Angeles (San Pedro), as well as the Palos Verdes Peninsula Unified School District and Palos Verdes Library District to join the cities of Rancho Palos Verdes and Rolling Hills Estates in this efforts Council discussed how many representatives from each city would attend the Peninsula Public Access Cable Television Committee meetings. Assistant to the City Manager Antil suggested that fu- ture Council discussions on this topic include whether Council representatives from each city should attend the Committee meet - ings. Council asked that Channel 3 programming be revised to make in- formation interspersed when the scroll is running, so it is less confusing$ MOTION: Councilman Kuykendall moved, seconded by Councilwoman Bacharach moved to 1) Authorize the Mayor to transmit to the City of Rolling Hills Estates, the City's formal notice to withdraw from the Palos Verdes Peninsula Cable Television Joint Powers Authority and (2) Authorize the creation of a separate, informal Peninsula Public Access Cable Television Committee by extending invitations to the cities of Rolling Hills, Palos Verdes Estates and Los Angeles (San Pedro), as well as the Palos Verdes Peninsula Unified School District and Palos Verdes Library City Council 4/07/92 7 District to Join the cities of Rancho Palos Verdes and Rolling Hills Estates in this effort. There being no objection, it was so ordered by Mayor McTaggart,, RECREATION AND PARKS COMMITTEE (1201) Assistant to the City Manager Antil supplied the staff report with the recommendation that Council adopt the resolution estab- lishing the responsibilities and duties of the Recreation & Parks Committee, City Council agreed that the resolution establishing the respon- sibilities and duties of the Recreation & Parks Committee should be modified to include that: the Recreation & Parks Committee should meet at least instead of once each month; the Vice Chairperson shall be selected by the Committee; the Com- mittee shall review the annual proposed budget and make periodic inventories and interpret the needs of the public and formulate policies relating to recreation services and programs that exist or new programs and projects that are proposed for 'implementation or may be needed; any member who is absent from any three con- secutive regular meetings unless excused from attendance by majority consent of such Committee expressed by action recorded in-its minutes, shall thereby automatically forfeit his or her position as a member of the Committee; and the Committee shall review and make policy recommendations to the City Council relat- ing to proposed recreation user fees and the rental of City recreation and park facilities, including price structure and level of City subsidy, if any, of these recreation programs and services, MOTION: Councilman Kuykendall moved, seconded by Councilwoman Brooks, to adopt Resolution No. 92-33 as amended, establishing the duties and responsibilities of the Recreation & Parks Com- mittee. There being no objection, it was so ordered by Mayor McTaggart, COMPARISON OF THE CITY OF LOS ANGELES AND CITY OF RANCHO PALOS VERDES COMMERCIAL SIGN REGULATIONS ALONG WESTERN AVENUE (1801) Acting Director Petru presented the staff report with the recom- mendation that Council review the Sign Code information and provide staff with direction, I Council discussed: that Eastview residents appear to be pleased with the signage in that area; the idea of pressuring the City of Los Angeles to update its sign ordinance; and the idea of notify- City Council 4/07/92 8 C -4 ouncil discussed: that Eastview residents appear to be pleased with the signage in that area; the idea of pressuring the City of Los Angeles to update its sign ordinance; and the idea of notify- ing the San Pedro -business group of information included in the Comparison, MOTION: Councilwoman Bacharach moved, seconded by Councilwoman Brooks, to receive and file the Sign Code information provided in the "Comparison of City of Los Angeles and City of Rancho Palos Verdes Commercial Sign Regulations Along Western Avenue." Without objection, it was so ordered by the Mayor, TELECOMMUTING CENTER (1505) City Manager Bussey gave the staff report with the recommendation that the City contract with Aldaron, Inc., to develop a prelimi- nary telecommuting program, including a funding program for a fee not to exceed $5,000. He called attention to the possibility of Federal funding for this purpose. Mr. Bussey also noted the pos- sibility of businesses sharing a portion of the fee and pointed out that GTE has already offered to do so, Council discussed the idea of asking Pao Bell to fund the program, 0 MOTION, Councilwoman Bacharach moved to give the City Manager authority to use GTE monies first, with the understanding that the City will look for other means to fund the remainder, with the City's portion not to exceed $3,0004 Council-man Ryan amended the motion to include that staff send a letter to the Public Utilities Commission and Pao Bell objecting to the general rate increase for the Oakland wire underarounding. AUDIENCE QUESTIONS Ms. Anke Raue, 28813 Rothrock, explained her hesitation to accept a City the for her work on the Trails' Committee. Council advised Ms. Raue that all committee members are treated equally and asked her to accept the tile, Mr. Andrew Sargent, I Peppertree Drive, related his feeling that all development in the City should be as restrictive as the City's Residential Standards. At 9:00 PM there was a recess until 9:10 PM when the meeting reconvened in regular agenda order... REPORT FROM THE DEVELOPMENT CODE SUBCOMMITTEE (1801) Councilwoman Brooks reviewed updated information provided by the Development Code Subcommittee, Council asked that the City Attorney review information compiled by the Development Code Subcommittee and that it be provided for further Council review, tentatively scheduled for June 2, 19920 APPLICATION OF VIEW PRESERVATION CRITERIA IN UNDEVELOPED SUBDIVISIONS (1806) Councilman Ryan introduced the item with the recommendation that staff be directed to prepare Code amendments for Planning Commis- sion and City Council consideration which would eliminate view preservation guarantees among housing units within still un- developed or new subdivisions. He noted a pertinent communica- tion Council recently received from residents on Alita Place. Council discussed whether view preservation guarantees should be eliminated; agreed that this topic should be referred to the Development Code Review Committee; and asked that the City Attor- ney examine the broad ramifications of revising Prop M to further the view goals of the ordinance. I City Council 4/07/92 10 MOTION. Councilman Kuykendall moved that discussion of the ap- plication of view preservation criteria in undeveloped subdivi- sions be tabled until such time as the Development Code Review Committee can address it. The motion was seconded by Council- woman Brooks and, there being no objection, it was so ordered by Mayor McTaggart* PRINTING AND MAILING OF RECREATION BROCHURES (1201) City Manager Bussey provided the staff report with the recommen- dation that Council authorize the preparation and mailing of the Summer Recreation Brochure and Aquatics Program Brochure on April 16th, if the parcel tax passes. He pointed out that the Summer Program impacts two fiscal years* Council discussed the possible funding sources for the parks and recreation programs, should the parcel tax fail. City Manager Bussey commented on various scenarios, should that be the case. He pointed out that the previous increase in the Spring Program has not affected sign-ups. Council discussed the idea of struc- turing the parks and recreation program fees to be self- supporting* MOTION: Councilwoman Bacharach moved approval of the staff recommendation to authorize the preparation and mailing of the Summer Recreation Brochure and Aquatics Program Brochure on April 26th, if the parcel tax passes, and to increase the parks and recreation program fees.to continue with the Summer Brochure, based on the increase in fees, should the parcel tax fall. The motion was seconded by Councilman Ryan and passed by unanimous roll call vote* CITY STRATEGIC PLANNING AND GOALS WORKSHOP (306) Councilman Kuykendall introduced the item with the recommendation that a workshop date be established to develop a long-range strategic plan and intermediate City goals. Council agreed to the date of May 30, 1992, 9:30 AM, fora - long- range planning workshop* City Council 4/07/92 LACTC VOTING UPDATE (306) Because a LACTC alternate is unavailabe due to illness, Council- man Ryan suggested that Councilman Croyts of Lomita also serve as Mrs. Hathaway-Francis' alternate to the LACTC. Council asked that a letter be sent to the League of California Cities Los Angeles Division asking that Councilman Croyts also serve as Mrs. Hathaway-Francis' alternate and that this matter be placed on the LACTC agenda immediately. STATUS OF DIRECTIVES In response to inquiries from Council at previous meetings, City Manager Bussey called attention to information regarding code en- forcement in the City of Cerritos, where a citizen Property Main- tenance Appeals Board is utilized. Council discussed the need for some type of revenue source for Code enforcement in the City of Rancho Palos Verdes. The idea of attaching fees to property maintenance Code violations to make them self-supporting was noted. Advising Council in this area, City Attorney Lynch explained that the courts have been coopera- tive in allowing cities to recoup costs in prosecuting property maintenance cases. Council suggested that this topic be included in budget discussions for next year. ADJOURNMENT At 10*405 PM, Councilwoman Bacharach moved, seconded by Councilman Kuykendall, to adjourn the meeting.
